License issues with mental health problems

Hi, I recently lost my license due to mental health issues as I was an impatient on a ward. I'm not going to go into why or how I ended up in this situation but please don't judge me for this, I bought a BMW 530d which I used to drive around without correct insurance or license, during the point that led up to my admission i crashed the car into someone else's due lack of experience especially since the car was RWD. afterwards I had the breakdown which led to my admission into hospital. I paid back the person's excess out of good will as his car was damaged (minorly) but led to £400 which I have paid £300 of it so far, my license was not taken off me by the police but my admission which I had to surrender my license for. Now I have a court date with a full hearing and I'm absolutely terrified for, I just want to know what type of charges I am looking at. I know what I did was wrong but at the time I was not mentally stable and I'm doing everything I can possibly can to make what happend right, including getting my license back so I can ride a motorcycle on a CBT. Sorry for rambling and thanks for taking the time to read and respond.

Firstly the most important thing is to concentrate on your recovery. Mental health issue are tough but with the right help it is possible to come out the other side stronger than you can imagine now.
In terms of the driving issues you are likely to face two convictions LC20 driving other than in accordance with licence. This carries a maximum fine of £1000 and 3 to 6 points. You also face IN10 driving without insurance. This is likely to incur 6 to 8 points and a fine set by the court. The normally assign the points from the most serious offence so it is likely you will receive 6 to 8 points if this is a first offence.
It is likely to take at least 12 to 18 months for your licence to be reinstated following a mental health related revocation so it is unlikely you will be back on your motorbike any time soon. When you do return to driving you will need to disclose the incident and convictions so it is likely you will be priced out of the insurance market for a few years anyway.

Thanks for the fast response, I was thinking maybe points on my license was the most possible outcome as well as a hefty fine. Due to my current circumstances as I asked my doctor he said I could reapply for my license on the 3rd of September and he will write a supporting letter explaining my needs, does this mean my provisional MAY be reinstated the DVLA are aware of my admission and said I need just 3 months of stable mental health and as I am doing quite brilliantly at the moment which is unlikely to change, I believe it will be reinstated with no issue with a deadline of the 18th of October. It’s up to the DVLA and not your doctor. The DVLA medical branch will take into account what your Dr says but are in no way bound by it.If you were acutely mentally ill when the offences were committed that’s strong mitigation and the court should take that into account especially seeing as you were sick enough to be admitted.1

I'd think there's also potentially a careless driving charge as well for causing the crash which could be up to nine points although as you've said it would only be points for the most serious offence which that might be.angrycrow said:Firstly the most important thing is to concentrate on your recovery. I think your point about being priced out of the market for insurance is the likely reality as new drivers face high costs anyway but with several serious motoring offences on a license it's going to make it far more difficult and expensive to get insurance.0 -

What are you being charged with exactly? There’s a no insurance matter and a driving without a licence.I’d expect 6 (or 8) points for the no insurance and a band C fine with a discount for an early guilty plea so down to 100% of weekly income plus costs and surcharge.Given your strong mitigation I’d imagine no separate penalty for the no licence matter.It’s up to DVLA medical when you get your licence back since you’re currently medically unfit. Hopefully you’re recovering and I wouldn’t worry too much about the court matter.1 -
