Car vandalized in hotel car park, who pays?

I left a hotel I was staying in to visit a relative in my car. When I got out I saw that my bonnet and wing had obviously been deliberately scratched deeply (keyed?). I returned to the hotel and spoke to the manager. He said he didn't think that the camera would cover the bay I'd parked in. Then he and a colleague looked at my car and said that they thought the damage was old. It definitely is not. They were implying that I was lying which I wasn't. I don't think they have even looked on the camera. There is no sign (that I have seen) stating that the liability is my own. I have reported it to the police. My car will need at least half of the body resprayed at great expense. I have no intention of going through my insurance. Do I have any recourse with the hotel?

    You either pay or claim if you cannot prove the hotel is liable.

    You would have to prove on the balance of probabilities that the hotel was negligent.  It happening while on the premises does not make them negligent by definition.  It doesn't have to specified that they take no responsibility.  You still have to prove their negligence.

    No, unless it was a hotel employee that caused the damage or the hotel were in some other way negligent.

    No to the OP.
    Trust me at times you do not notice a big scratch until its point out to you, EG  The previous Renage Rover, keyed on rear passenger door. I'd driven the car that day, parked up in daylight - did a few things on the drive and car was parked nearst to the front door - then our son came to our place and asked when was the car vandalised - I did not even see it and I usally have a quick glance around the car if parked in a car park or left on the road - what i am saying honestly is it's not always obvious until its pointed out or you see it.

    You will have to repair self pay or via insurance.

    every hotel i have been too and other car parks they say you park at your own risk unless in a log term secure carpark some will cover if its only their staff going in and out of the car park, like hotles on park land valet parking.
  • If you think the hotel are deliberately withholding CCTV footage then you could take them on Judge Rinder. But that doesn't prove they did it. Most likely it's gonna be you or your insurance.

    Your own insurance or your own back pocket are the two best options. There's no proof the damage was caused at the property concerned, and could easily have been done the night before wherever the car was then - or two days earlier in a multi-storey car-park. Unless you can prove it happened on their property as a result of their negligent staff - it's unlikely your request for compensation will get anywhere.

    If i parked at your home and my car gets vandalised would you be paying the grand or two to fix it?

    Pay for it yourself or claim on your insurance

    Its going to be expensive then, its what insurance is for
