What £350? I've no idea where you got that from?
What £197? You are not paying CEL.
As for the set aside fee it's £100 if CEL consent (but they won't, see the other thread this morning where a person had quite a threatening person on the phone trying to tell them the CCJ would only be set aside if they pay the PCN, haha!).
So the court fee is £255 but you ask the Judge to Order that CEL pay that, at your set aside hearing.
Your only cost is £255 and you ask for that to be ordered back at them!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As above. No idea where £350 comes from
A set aside without consent costs £255. That is paid to the court. No payment to CEL. Assuming you do it well, you get granted your set aside and should either get this money immediatley back from CEL or it is "reserved" meaning at the hearing for the actual CLAIM once you win you ask for it backplus your costs of the hearing.1 -
Yeah. Sorry not Making myself clear. I am thinking of paying CEL now for a Consented set aside because we actually contacted CEL last Sept (when we found out about the CCJ after finding out from the court) and they offered us to pay them the £ 197 reduced rate and then we pay £100 for the set aside. But we never acted then as we did not understand the set aside or what CEL meant... We were angry... Then we happened upon this site
NO excuse on our part tbh - we had an illness in the family at the time this was going on but really no excuse. We feel so annoyed with ourselves that we didn't act sooner. So when I sent the email after speaking to you guys CEL mentioned this contact we had with them last year and deemed it that they had tried to contact us at our new address after we contacted them but we did nothing. So they said their offer still stands.
Now I worry that the judge will look badly upon this and not acting promptly enough and won't accept this as a defence if I went for a CONTESTED set aside. Hence the reason I was thinking of paying and going for consented. But worrying if the judge will Still accept the consented set aside because if we pay is this likely to result in the judge thinking we accept responsibility or did not act promptly enough?
Very confusing
Hope this makes sense.
Just not sure what to do. Feel like I've let them walk all over me. 😡0 -
But you already know from reading a zillion posts by @henrik777 that promptness is NOT NEEDED if it's a mandatory set aside. Don't ask what the difference is, read his posts about it...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No need to act promptly - CPR13.2
Mandatory set aside due to form not being served
NEed to act promptly - CPR13.3
You dont seem to understand, 5 pages in, that there are two routes for a without consent set aside. Only one has a time limit, and you plead it anyway because it doesnt hurt to do so.
You're prevaricating. Stop asking if you can do it, and do it.1 -
... and don't pay the scammers, only the set aside fee if it is without consent.I married my cousin. I had to...I don't have a sister.
