Yes, but please do also try to get it set aside.  Paying a PPC hurts.  Fight back.

Also, please make sure you come back and look out for when the new Code of Practice comes out for public consultation soon. Your voice needs to be heard after what you've gone through.  If you changed the address on you driving licence, IMHO people should be putting in comments suggesting the DVLA is at fault, has failed to properly handle address data for a known data subject and report them to the ICO and add your thoughts about the DVLA's fault in all this, to the new CoP comments.

I don't think enough has been exposed about the abject failures of the DVLA from 2012 to guard our data properly.

They've just dished data out in tens of thousands per year, per PPC (some 8.4 MILLION releases to private parking firms last year...).  As long as a PPC is in an AOS, the DVLA waved it through and no-one appears to have had the due diligence to ask on the KADOE submission for the location of the car park (so they've never been able to check for cash cow sites and protect anyone by at least identifying the scam sites...it would have been SIMPLE).

And on top of that, they are failing known data subjects by not changing the car registration address when people change the address on their driving licence. Being a separate department doesn't cut it.  IMHO it stinks and ICO complaints need to go in about the DVLA.  They had a duty to put it in LARGE LETTERS when returning a driving licence duly changed to a new address for a data subject, that the person also had to separately apply to change the V5C of car(s) owned.  Small print doesn't cut it.

I see the DVLA's involvement in these CCJs as major and I'd like to see the ICO view on this.

    I'll definitely be doing that!

I'm just sorting a cheque and letter out now. Sorry to keep asking what may appear as naive questions but I haven't actually seen an physical documentation for this CCJ. If I just put "Excel Parking Service Ltd" on the cheque I'm guessing that will be sufficient and just post it to their listed address?

Last one; I'll be sending a copy to the court, do I ask for them to remove the CCJ given it has been paid within the month period?

    Thanks again all

Write the CCJ reference , plus your full name and address on the back of the cheque , as well as in a covering letter

Send copies to the CCBC , also asking them to expunge the CCJ due to prompt payment

Hi all, thanks for the help so far, cheque and envelopes are all ready to go, just about to print the letters but just checking theres nothing specific I have to put on?

I've got on the letter to Excel, the reference number, vehicle reg, my details etc and just stated I have sent a copy to CCBC. On the letter to CBCC I've got a copy of the one to Excel and a cover note asking for the CCJ to be expunged as it was paid within a month - anything else I need to add to ensure a quick and easy resolution?

    Thanks

Are you not adding that this is paid under protest and that they failed to trace your address and serve the claim to the right address, so you will be seeking a set aside and to defend the claim?

I was going to but I didn't want to give the impression that they should expect further paper work at this point. I just wanted to show it was paid promptly and I expect it to be removed promptly. If you think it's worth putting it on without slowing down the process of having it removed I can add it.

You can't slow down the process.  If you pay it then it's paid.

And your letter is deemed delivered 2 working days later (remember we have a bank holiday coming up so if you post as late as Thursday (at a PO with a certificate of posting - NOT SIGNED FOR!) that's not deemed delivered till the following TUESDAY.
