Hi we have a 43 year old disabled daughter who receives Working Tax Credit and Disability Living Allowance. A couple of years ago we bought a small house in our names and moved her in to see if she could live independently. This has been successful with daily support from us. She works part time and earns about £9,000 per year. We would now like to "Gift" or "Transfer" the house to her.
We would like to know if this would affect her benefits in any way ?

DLA isn't means tested so will have no effect - presumably at some point in the near future she's due to be migrated over to PIP (also not means tested). As she's living in the property, I don;t believe you gifting it to her would affect her WTC, but I'm not an expert and suggest asking over on the benefits board here

It won't affect her benefits even if she did claim a means tested benefit in the future then the house you live in is disregarded for all means tested benefits. However, there could be problems for you if you claim any means tested benefits now or in the future, if you gift the house to her.1

This is one of those where it would be best to get legal advice.2

Hi, hope you don't mind me asking, what is her occupation as this may affect the outcome if she migrated to PIP in the near future?

Of course people work and claim a disability benefit. However, if the work they do contradicts the reasons why they're claiming it then it can go against them.
