New car return/refund possibility?

I'll try and lay out the facts... 
New car ordered through drive the deal, built to order. Order to delivery time 4 months. 
All transactions done online /over the phone with DTD and supplying dealer. Only visited dealer once, on collection day. All finance sorted over the phone, deposit paid online days before I collected) 
Car is great but its back breaking when driven over 90 minutes (I did test drive another car at a unrelated dealer but the comfort issue didn't arise in a 20 minute drive) Car owned for 6 days.

Am I stuck with it? Or have I chance of a refund thru distance selling regs etc? (I think I know I'm stuck with it but am praying for a miracle!) 

Anyone successfully returned a car under these circumstances?

  • As the car is not faulty, you have no grounds to reject the vehicle.

    You have no legal right to return a car because you don't like it. There is no fault with it.

    You MIGHT have a 14-day DSR return right, if you only collected the car and didn't sign any of the purchase paperwork. See scenario 4.

    I appreciate the is no inherent fault with it,and that it won't /can't go back under those circumstances. That's fine and accepted.

    I do believe I fall under scenario 4 of that link though. I only physically visited the dealer on c ollection day. All paperwork/finance/deposit payments etc were done online and over the telephone.

    I was curious to see if anyone had successfully returned under those circumstances??

    The reality of new car depreciation.

    Might be worth talking with the dealer, but to be fair this wouldn't have been something you could have identified even if you did buy direct from a dealer...

    I would be considering other solutions. What car is it out of interest?

    This happened with my new car (4 years ago), but in playing with the angle/height of the seating, distance between pedals seat, steering wheel height I finally found a setting that didn't hurt. I commute 2 hours a day so it was a big deal and I totally feel your pain!  I still have the same car. Once after a service I go the crippling pain again and realise one of my settings had been fractionally altered, putting pressure back in the wrong place.  Bolts of pain after about 30 minutes. If you're stuck with the car, don't give up on it immediately!

    What car is it that you can't tolerate a 90 minutes drive?  Most cars now have well designed seats

    Changing seats etc isn't really an option these days with all the tech in modern cars, airbags, electric adustment, etc. Not really an avenue to go down I think. Not to mention the costs or insurance implications. 
    I suppose I could look at getting the seat bolster shape adjusted/repacked - I will investigate that this coming week with some car trimming companies. 
    I have contacted them with regards to a 14 day DSR return but have had no reply yet.
    I darent ask them how much they'd buy it back for! 
    Not that it really matters but its an Audi RS3.
