Harvey's in administration offers no warranty

Hi hopefully someone can help me with my query. On the Harvey's administration website it states that you effectively have no warranty.

Warranties for Harveys Furniture products cannot be honoured.
Any claims you have under the guarantee will be an unsecured claim in the administration. It is too early for us to say whether unsecured creditors will receive a payment on their claims.
My question is as you have no warranty does this constitute a breach of contract allowing you to cancel the order? Surely no one can be expected to buy an item for so much and have no warranty.
Thank you
Thank you

Why should you expect a warranty? Warranty is an addition thing above and beyond your statutory rights that in England gives you up to 6 years of rights.
You need to read your contract to see what it says about the warranty, variance of terms and cancellation rights. Even if you do have a right to cancel you will still be an unsecured creditor when it comes to trying to get back any deposit etc though a chargeback or S75 may be possible depending on payment method.0 -
Thanks you do have a point but I personally would never buy a sofa without a warranty. We are not overly bothered about the deposit as its only a low amount however I do also worry if they go into liquidation in the meantime and we don't receive our sofa.0

Unless its an insurance backed warranty then your statutory rights are often better than what most warranties give you, they're just less hassle generally to claim against. If it is insurance backed then it moves things into a slightly different space as its a seperate company, less likely to go bust, more regulated industry and opens up the FSCS and FOS if things do go wrong.
Still read your contract on the points mentioned to see if it creates a termination right or maybe just speak to them and see if you can make an extra-contractual termination if there is no termination rights at all.1 -
There is a statute of limitation in England of 6 years. There are no consumer rights that give 6 years of 'rights' in England.Sandtree said:England gives you up to 6 years of rights.0 -
And it's a good thing that Sandtree didn't state that you have 6 years of consumer rights.theonlywayisup said:

What they did state was that you have up to 6 years of rights and this is correct in that you generally have up to 6 years to pursue your legal rights.0 -
Perhaps read again. Or even better, give some input yourself. Not your MO though is it.Hermione_Granger said:

Separate question. Husband and I bought our Harveys sofa in December 2016. It is all fully paid for. Recently a support beam has broken leading to sagging on one side. When we bought our sofa we had a 10 year guarantee - obviously with Harvey's in administration we don't know where to begin with dealing with this. Does our guarantee still stand? Who do we contact about this?0

Is the guarantee underwritten by somebody other than Harvey's?Tubbster said:Separate question. Husband and I bought our Harveys sofa in December 2016. It is all fully paid for. I would suggest that the 10 year guarantee was part of the product/service that you purchased.Tubbster said:Separate question. Husband and I bought our Harveys sofa in December 2016. Did you use any form of credit when buying the sofa? Credit Card? In store finance agreement?
If so, you have exactly the same rights against the credit provider as you have against the seller.
Have a read of MSE's Section 75 refunds article for details.1 -
