I will notify the local MP/MLA tomorrow about continued pursuit of the charge, as anyone who had paid it would appear that by their assertion that it was issued correctly any one who has already paid is unlikely to have been refunded. I will update the existing complaint with the BPA to include the absence of a POPLA code.3

Update: they cancelled it an hour ago, they yave up easier than expected.
BPA complaint amounted to nothing, the points raised of not having land owner permission owing to it be a public road and no popla code on rejection of appeal were swept aside. The lack of popla code was because the appeal, submitted through the appeal section on smartparking website, smart parking chose not to be an appeal apparently. The BPA said they had reviewed the contract and were happy it did not breach their code. I have already requested the deeds and ownership info from the land registry. Hopefully I can help get all the other ones cancelled as well.

Please follow up your complaint to the DVLA once you have proof the land is council owned/a public road. Include the fact that the BPA have taken no action about this sanctionable "offence" by one of their members which brings the suitability of the BPA into question. Include the council's comments/instructions to the scammers that the BPA seem to have ignored.

Consider that done, once I get the registry info I'll be forwarding it to him as his office has the contact details for dozens of charges people hopefully it can get the others cancelled or refunded in addition to highlighting the impotence of the BPA.5

Can you confirm that you complained specifically to Steve Clark at the BPA? Surely he didn't defend this? If you didn't deal with Steve, now forward it all (including your evidence) to him and say, even though your PCN is cancelled, the MSE community are extremely concerned that Smart have been issuing PCNs on a public highway and have not yet cancelled/refunded those of other less hardy victims.
