32 Month old PCN ?????? First Contact

Hello all,

Today I've received a 'LETTER BEFORE ACTION - CLAIM FOR DEBT' from Civil Enforcement Limited for a supposed breach of parking 32 months ago. They haven't provided me any evidence to my address which I've lived at, and been registered to for the past 24 months.

They've sent me a form to reply to which is asking for name, address, contact number, email and to comment whether I owe the debt, am I getting debt advice and another section where i can ask them for further documents or information.

At this stage I cannot confirm that I had parked at this premises. Being a Burger King I have visited many times myself and with family in the past.

  • Recommendation so far has been:

"send them a single letter telling them that you deny that you were involved and that you won't be paying anything that you will see them in court.

Send them a second letter separate containing an sar"

Email the SAR to their DPO at CEL , also email a data rectification notice with your current address if you have moved in that time , this also goes to their DPO , to remove any old details

Get the V5C out and double check the current name and address are correct , update them online asap if incorrect

*email* as above. Never post. Not worth a stamp.
  • Ok,

The car I sold 2 years ago (unconfirmed date) and so the V5 hasnt been in my name for a considerable amount of time.

Should I still do a Data Rectification Notice since they have only just been bothered to check the Electoral Role?

    Roll
Yes. Tell them your current address.
  • I've also been told that the problem with e-mail is that, if the matter ever did come to court, they could e-mail you their documentation one minute before the deadline and catch you out.

How does that cacth you out?
The deadline is say 14 days before court. Your deadline is the exact same so you could do the same.

Was this 'on the telly', or from someone 'down the pub'?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
