Work Holidays

I was supposed to finish up on holiday from my work place the day after lockdown. I had received my weeks holiday pay that was last wage i got when furlough kicked in all of my colleagues received 6weeks pay i received 5 and was told that was because id had my holiday pay which was fair enough. so i asked if i was then to take my holiday once trading again to be told no. So ive now had no holidays and the same wages as everyone else and theyve all been told they still have there full allocation which has totally confused me as i never actually got my holiday as we were on furlough. Any advice would be greatly appreciated thanks

I assume that you mean you have one week less holiday available to you than your colleagues, because you booked holiday on a week you were then furloughed. There is nothing wrong with that, so long as you were paid full rate for that holiday. Lots of employers have told employees that they have to take holiday while on furlough, and you and your colleagues are fortunate that your employer hasn't done that.2

Unless your employer told you that you can't take holiday during furlough or you asked to cancel the booked leave and your employer agreed then you've taken a week's holiday. It's not your employer's responsibility to ensure there's something for you to do while you're taking annual leave.
Not sure what you mean by saying you got 5 weeks pay. You should have got at least 80% of your normal pay for the days you were furloughed and didn't have leave booked and 100% for the days you were on furlough and did have leave booked, including Bank Holidays if you normally have Bank Holidays off.

If you were paid holiday pay for the week, then you are not out of pocket. You may not have been able to enjoy the holiday but surely you don't expect your employer top give you another week off because of this?0

What about if the OP had something planned for the furture. OP has every right to complain and even take to ACAS IMO0 -

The OP had booked a week off so was unavailable for work. Nothing wrong with what the employer has done. If he has something planned for the future then he takes more annual leave.sweetsand said:Why not?

If they had something planned for the future then surely they would already have booked that time off. Absolutely no room to complain - they didn't cancel the holiday and took it so can't expect it back now.sweetsand said:

A plan does not need to be booked well in advance.LilElvis said:

And the employment law to back this up? Remember an employer can tell an employee when to take all their holidays subject to sufficient notice.sweetsand said:

Seems a lot of employers are confused about holidays over the covid period. My employer seems to of totally ignored the fact there were 4 bank holidays during furlough. These are usually tsken as part of our 28days annual leave. We were paid the flat rate of 80% and no top up for the bank holidays. By reading the gov website we should of been paid full rate on those days or be able to take those days later in the year. My empliyer disagrees saying we had the time off.0
