Jet2 Canary Islands - Holiday Curtailment, what are my rights/options?

Hi All,

My family is currently in the Canary Islands on a package holiday with Jet2 due to return on Friday 7th.  With FCO advice for no new travel to the Canary's Jet2 have decided to return all customers early to the UK.  We are now due to return on Monday 3rd.

I am wondering if I can expect any form of refund for the shortened holiday (roughly half as long)?  Or if we decide to stay on (as recommend by the local rep) can we claim for the cost of our new flights on Friday (plenty of other airlines are still flying)?

One concern is that Jet2 referred to the return flight as being a direct consequence of the FCO advice.  This is not true, the FCO have clearly said that those currently in Spain should remain until the end of the original holiday.  Separately in the media Jet2 have put the reason down to not wanting to fly mostly empty planes back and forth.  I can understand the reason, but it is a business decision and not one enforced by the FCO (so concerned they will use this to avoid payment).  Their contact centre said "no decisions have been made regarding refunds" and to email them on return and wait 28 days for a response.

There is also no paperwork, no email, no text.  Just a handwritten note on a scrap of paper handed to me yesterday with the new flight time.  Hard to claim on insurance with zero proof the flight was changed!

Apologies for the length, hopefully it all made sense.  Thanks in advance for and help or guidance.

Hi - Jet2 are now offering refunds for Curtailed holidays and extra flight costs - There is an article on the BBC News website - if what they offer you is insufficient youMAY be able to claim under the Curtailment part of your Travel Insurance  but this is unlikely as Jet12 will have made an offer

    Thanks for your reply.

I've seen the article but unfortunately the Jet2 contact centre won't confirm.  They also say (article) they will refund the rooms, problem is that this component is less than half the cost. So half the holiday= 20% refund.

We've also decided to stay until the original date and fly back with Ryanair.  So will Jet2 refund these flight costs?  This takes us back as scheduled so in theory yes but Jet2 are saying they are fulfilling their responsibility by flying us back (early) and we are refusing.

There has been zero info apart from the few quotes in the BBC article, so just trying to see what options I have.

    Thanks,
    A

You could by all means try to claim but I’m not sure you would be successful given that Jet2 are offering you a repatriation flight back to the U.K.  I think their obligation to you would end at that point if you decided to refuse their flight back.

However it's not a "repatriation flight", it's Jet2 deciding to send customers home early (against FCO advice) to save money.

Today they have announced they will be refunding unused hotels but not flights.  So e.g. a 10 day family holiday costing £1,000 (700 for flights, 300 hotel), you're sent home after 5 days, they refund £150.  So 50% of the holiday lost but only 15% of the cost refunded.  I really can't see how this is in any way legal, moral or fair?

Take them to the small claims court and test it out.

    I agree with you.
I don't know if you will be able to claim though. Basically they should refund you the cost of your alternative flights home. Whether that will happen or not.........

  • T&C entitles you for compensation for significant changes. So go for your cost of your new flights and also inconvenience costs.
It would be interesting to see if there still is a scheduled Jet2 outbound flight to Canary Islands on 7 Aug....which you could still get.

Their flights resume on the 10th - so they are only stopping flights for 6 days!
