Currys - laptop purchased as new only to find out it was registered a year before we bought it

Hi,
I'm hoping that someone maybe able to help. I brought a Macbook from Currys just over a year ago (May 19) and its now got a screen issue.  I took it back to my local Currys who advised me its out of warranty and to take it to my local Apple store as they will be able to fix it under the 2yr purchase thing?  So in the Apple store they advised that it was registered a year before we purchased it (September 18) so any warranty with them is now no longer available.  Taken it back to Currys who have now raised a case with Save our Customers team but my concern is where do I stand with Currys as I purchased what I thought was a new laptop only to find out its been previously registered with Apple.  Apple Tech suggested that it may have been purchased that then returned unopened? 

Any help with this wold be great as I really don't know where I stand.

    This is the other side of the coin to so many threads on here, where people buy in-store and can't understand why the retailer won't allow them to return the product for a change of mind. "I only turned it on once, set it up and realised I didn't like it, so why won't they take it back and give me a full refund?"

    Have Apple given you anything to be able to prove to Currys that it was registered before you bought it?  Obviously not personal details, but something to prove it?
  • I have a Genius Bar Work Authorisation form with the cost of the repair and also the Apple Tech documented he had seen my receipt to prove proof of purchase but their system warranty started before on the 05/0918

    I am a bit confused.
    It is wrong that you bought a new laptop May 2019 that turns out was used.

    But, Apple say first registered September 2018.  It is only now August 2020, so still within 2 years.  

    Something seems not quite right.

    The warranty is probably registered with the original owner and non transferable.

    Apple only give a 1 year manufacturers warranty in the UK but it is often misquoted as 2 years because that is what it is in the rest of the EU... this is because the EU directive in the UK was satisfied by  SoGA and then CCA which gives you up to 6 years claim against the retailer whereas in other european countries a different a different approach was taken.

    When you bought it did you not attempt to register it in your name and then hit the problem of it saying it was already registered?

  • When I bought it from Currys the laptop was sealed as new and I didn't realise that I needed to register the laptop anywhere and Currys didn't advise that I needed to. I have brought Macbooks previously from the Apple store and not had to register it so didn't think was any different.

    I know what you're trying to say but it's not quite correct.

    The Sale of Goods Act 1979 was the previous primary legislation for all sales (consumer and business) in the UK. Following the EU directive coming into force (from which some people oft misquote the "EU 2 year rule") the SoGA was replaced by the Consumer Rights Act 2015 for consumer sales. (Parts of SoGA still apply for business sales). To add ... online/distance transactions are supplemented by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

    Warranties are extra / outside of consumer legislation.

    PS: the 6 years comes from the Limitations Act 1980, which gives a claimant 6 years from the date of the breach of contract within which to raise a claim. (5 years from discovery of the breach is the limit that applies in Scotland).

    I would be going after Currys on the basis that they sold you a second hand laptop as new and it was therefore not as described and you now wish to return it as  you have no idea how it was treated in that year
    Have Apple put in writing that it was registered to them A year before Currys sold it and that if it had not been they would have repaired it? If not perhaps type out a statement of fact and ask Apple to endorse it. If they refuse then you may question what they are telling you
