Debt Recovery Plus Legal Action


Hi, I have received this letter threatening legal action from Debt Recovery Plus because so far I have not paid the parking fine. I have up until now ignored the letters because the fine is for 'parking on yellow lines' in a Sainsbury's car park and as far as I'm concerned they are chancing their arm as there are no yellow lines. The photograph in the original letter from UK Car Park Management showed me parked slightly on a line of a parking bay as you can see from the second image. Could some one advise please how could I reply to this latest letter?

Do not reply to any debt collector letters , instead read the Newbies FAQ sticky thread near the top of the forum , especially the fourth one
It's a proper 30 day LBC or a Court claim form from the CCBC in Northampton that you deal with , not boring debt collectors with no powers2 -

It is not a fine, it is an invoice from an ex-clamper to compensate them for the alleged harm they suffered when you did what you did. We call it a scam. Pay them not a penny unless a judge so orders it.
Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Thanks I have read the thread is it worth now replying to the original PCN form UK Car Park Mangement or wait until they decide to go via the solicitors route? I have no intention of engaging with Debt Recovery Plus.

It's always worth one appeal to the parking company , retaining proof of the communication , as part of any paper trail to show a judge you tried to deal with it
You can and should expect a standard rejection to your appeal , which again is a part of the paper trail
A landowner cancellation is ALWAYS the best option , at any and all times , especially before any court case , so any communications are again a part of the paper trail
Never leave or show personal information on a public forum , like PCN references etc
Redaction is only useful if correctly performed , yours isnt1 -

There doesn't seem to an edit facility to enable me to delete?
If you can't edit it yourself then send a private message to one of the board guides and ask them to delete the images but not the thread. Board guides for this forum are soolin, Crabman, and savvy.
Use the notification icon at the top of the page that looks like an envelope to do this.
Looking at the pics in your NTK, it would have been impossible for the driver to park any nearer to the car and still be able to get out.
The tyre appears to be on the line not over the line.
The sign in their pics are illegible. It would be worth getting your own pic of that sign from a driver's point of view, as well as other pics of the site and signage, especially signs that are damaged, dirty, hidden by foliage, high up on poles, round corners etcetera.
However, the most important thing is to answer the question you were asked about the store manager's reply when you complained.
