Top of chain is taking the biscuit!

We had a completion date for next week all agreed. The chain is of 3 houses which includes a ‘vacant property’ at the top, to be assumed the owner had deceased. 

I’ve just had a call from the EA to inform me that the house at the top of the chain has come back and requested an entire month to move out. Now this has caused some issues as we’ve now ordered furniture and booked in the removals etc for the agreed date. We have also booked a 2 week break at the end of the month into September (booked before house was on the market). I’m not sure of the position of the seller to us is but I can imagine they are a little annoyed too...

I’ve now requested with my sol that the date sticks as we can’t then commit for another 3 weeks until we’re back. Is there anything we can do? I guess other than to threaten to pull out of the chain (which we definitely don't want to do)?

    You have just as much say on completion date as anybody else in the chain... Including the vendor in question.

    Do you mean that they want a month between exchange and completion?

    All you can do is try to persuade the people at the top of the chain and/or negotiate a compromise. It's a matter of who gives in first (or who walks away first).

    It’s a simultaneous exchange and complete. I’ve emailed my solicitor pushing back with the original agreed date - I’m even happy to offer my time if it speeds it up gutting the place!

    We were given the go ahead to book these things as the date was confirmed and contracts unofficially have been exchanged. I’ve also emailed to whether it’s better to now exchange now and complete when we do.

    Until contracts are exchanged there is no firm completion date so you should not book anything.

    Contracts can not unofficially be exchanged they are either exchanged or they are not.

    There is no such thing as unofficially exchanged
    Told by solicitor that the signed contracts are in the hands of the sellers solicitor but separately told we’re going for a simultaneous exchange / complete (TBH my solicitor has taken over the file and isn’t the best). Just going off what I’ve been told by the solicitor.

    Pulled what situation. Until you exchange contracts there is no completion date. This is one of the downsides of simultaneously exchanging and completing.

    You all need to agree between you.

    No you didn't, it's not confirmed until you've exchanged. Until then anyone can change their minds or even pull out completely.
