    He can only get a refund by using the V778, which you now hold, and if the plate has not been assigned to a vehicle.  If he was to apply for a replacement V778 it would be rejected as the current "lost or stolen" one is no longer valid because the number has been assigned to a vehicle.  The only way he could do it would be to tell lots of porkies to DVLA who would ask you for your side of the story.
