Problem with IMEI Blocked phone

    Whilst I could understand Music Magpie retaining the phone if the CheckMEND report stated that the phone is listed as stolen so it could forward the phone to the police, that doesn't appear to be the case here.
    All Music Magpie has established is that EE has blocked the IMEI.
    So, whilst the fact that the phone is blocked means that Music Magpie won't buy the phone off the OP, it does not entitle Music Magpie to deprive the OP of their property.
    Unfortunately, the only way the OP can enforce their title to the phone is through the courts. Which will cost far more than the phone is worth.

    I don’t thinks that’s right. The legislation says that if you come into possession of a handset with an IMEI that has been added to the register then you cannot return it. That’s why all recyclers, insurance companies, repairers and retailers make this clear.

    The trouble might be if CEX can prove they have a clean checkmend report when they purchased the phone originally. I’m not sure (legally) where that leaves you. 
    In that case I suspect its tough titties to the OP. Otherwise there's nothing stopping someone buying a perfectly working handset from CEX, then later on claiming its 'lost' and getting a new handset off their mobile insurance. Obviously the phone's IMEI would then have been barred/blacklisted so the person could go back to CEX and say they were sold a blacklisted phone.

    The Op doesn't have title to the phone nor is it their property.  The phone is stolen property and therefore title to it can not be transferred.  Once the original owner reported it stolen and claimed a new phone, title to the first phone would belong to the networks insurance company (should it ever be found).  There is no way to circumvent this.  
  • I thought CEX would have the sellers details. If you sell them anything you have to have 2 forms of ID.  Also if I'm correct they also have a statement in their stores saying they will pursue the seller for the money they paid if they report the phone stolen/lost.

    Wrong information. 

    You do not have to have two forms of ID at all.
    Not even one type - a bank card with just a name on will work, to gain access to a full selling account, you give them an address and DOB and they take it in good faith.

    Please research in future.

    Just researched as requested.  My apologies you only need one form of ID.
    From CEX website:

    Exchange Membership
    You do not need to bring ID to sign up for Exchange Membership.
    We just need your name and postcode.


    Note: Exchange Memberships allow you to trade-in all items except mobile phones and devices having IMEI numbers. If you want to trade-in or sell mobile phones or any IMEI'd device, you will need Full Membership. Exchange memberships can only be used to sell for a CeX voucher. To sell for cash you will need a full membership.


    Please also note that in the Greater Manchester area customers must be a minimum of 16 years old to set up an Exchange Membership and/or a Full Membership.


    Full Membership
    Selling to CeX is fast, friendly and fair. If you're exchanging a Phone or selling anything for cash you need a full CeX membership, which is free. A full membership allows you to sell all items for either cash or credit voucher.

    In England, Northern Ireland and Wales full members must be at least 16 years old and be able to present ONE of the following ID:

    • Current Signed Passport
    • EU National Identity Card
    • Current UK photocard Driving Licence (full/provisional)
    • Police/Armed Forces Warrant Card
    • DWP Benefit Book or Card
    • Utility Bill (not more than 6 months old)
    • A current bank/credit union/building society/credit card statement (not more than 6 months old)
    • Council Tax/Rent Book
    • Disabled Drivers Permit
    • Debit/Credit Card
    • Citizen Card

    Note: All ID must be current and original ie No out of date Passports etc. and no photocopies.
