My Company have told me the money I received on Furlough is my Statutory Redundancy Pay !

Options
On 19/3/2020 I was laid off work - no work and no pay.
Then Furlough came into existence and I was Furloughed from 01/04/2020.
My Company told me not to worry and no of us will lose our Jobs.
On 02/06/2020 I received an e-mail telling me I was being made Redundant Today.
In the letter I was told I would be Furloughed until 31/07/2020 and I would NOT receive my Statutory Redundancy Pay or any Holiday Pay as the June and July’s Furlough Pay will cover the Holiday Pay I am owed together with the Statutory Redundancy Pay.
I feel this is not right as I feel that other People who have been made redundant by their Companies are receiving their Statutory Redundancy on top of their Furlough.
Should I ask my Company for my Holiday Pay & Statutory Redundancy Pay on top of the Furlough Pay ?
I am waiting to see what I receive on 31/07/2020 as my Final Pay.
I do not want to ‘rock the boat’ until then seeing as Furlough is a voluntary scheme by Employers and they can withdraw it at anytime.
I look forward to others peoples advice
Thank you

This is definitely illegal surely. But yes i would wait and if you then don't receive what you are legally owed I would be reminding them of their obligations in writing quoting the relevant law.

Yes, I do feel it is NOT right.
I will wait for 31/07/2020 for my final Furlough payment and see what I receive - they may pay the Holiday Pay and Statutory Redundancy Repayment on Top.
    Thank you for your advice.

They can ask you to take annual leave during notice and if furloughed they need to pay 100% for this time.

Redundancy pay no they absolutely have to pay this to you separately from your notice. How long have you worked there? Are you definitely entitled to SRP?

They asked me to take some of my Annual leave whilst being furloughed and they did pay me at 100% but I still have some Annual Leave left over.
I have worked there just under 3 years.
I would say I am definitely entitled to SRP - not much but anything is better that’s nothing and I feel out of principle I am owed this money.

6 October 2017 to be exact.
Why do you need to know the exact date ?

The anniversary is important because SRP is based on complete years length of service. In your example, you would actually only be paid for 2 years SRP because you have worked there 2.8 years. It's frustrating I know, but unfortunately that's how it works.
What your employer is proposing is illegal, there are very clear statutes around this. Furlough money can be used to pay your contractual notice (we'll not debate the morals of this one!), but the employer has to pay your SRP separately.
Also, how many people are being made redundant in your workplace? Have they followed any kind of Consultaton process ie telling you were 'at risk' and then completing a series of meetings, either with each person individually or with group representatives?

Were you ever put under consultation of redundancy ? Or did you just get told you’re being made redundant? Redundancy has to follow a process. Your furlough money is still your earnings. You have to be told your under consultation. Then be told you’re being made redundant. After this  you then  receive your statutory Redundancy pay, your payment in lieu of notice and Any holiday pay due. They cannot just tell you your jobs gone and cease paying you. If your employer doesn’t have funds for redundancy because they go into administration there is a government scheme which you can apply to and the government will pay your redundancy.
