Desperately need help, don't know where to turn, unusual problem

Hi all.  Not sure where to post this.  Here goes..  In January my then bf and I booked flights to Australia and a hotel.  He paid with a debit card and I paid him my half with a bank transfer.  We broke up in March.  Flights cancelled late May by Netflights (this is being processed) so of course we had to cancel the hotel (booked through booking.com).  The hotel wont refund the money so I told him to claim via his travel insurance.  He made one phone call and they said no, he refuses to do anymore. Wont get anything in writing, or complain to the ombudsman or try to use chargeback on his bank account.   Where do I stand?  He said he would pay me back but its been two months.   I only have a telephone number now to keep in touch and am afraid if I push it he could block me.

I do have packaged travel insurance with my bank account.  Would they pay or should I try chargeback with my bank?  I cant afford to lose this money £704.

Any help would be very gratefully received!

    If the hotel is still open, then chargeback isn't an option.

    If your insurance covers you, then use that.

    Thats all well and good but I would wager she doesnt have any of the paperwork and trying to get it sounds like it will be like pulling teeth

    Charge back is not an option as you did not pay for anything-only paid the Bf.

    Travel insurance would be the way to go, you should be able to claim for the accommodation as FCO advice is not to travel and the Bf has made attempts to get the money back.

    Hope your Travel Insurance covers this, though they may push back and ask the BF to do a charge back before they pay.

    Unfortunately you are at the mercy of your Bf...

    I don't get the "can't afford to lose ££££ from people.

    You quite happily paid this out for a holiday so it's"lost" already. Fair enough you did not get anything for it.

    If the hotel is open, accepting guests and a non-refundable rate was booked then a chargeback on his bank account would fail. Whether his insurance should cover the cancelled hotel will depend on the terms of the policy - many would not. If not then there is nobody to claim from.
    You cannot use a chargeback.  Whether your insurance would cover you would depend on the terms of your policy

    If your insurance doesn't cover (am doubtful), the only person who can give it back to you is your ex and if he says no, then your option is probably to take him to court.   But if he hasn't got it from the hotel himself then it might be tricky.    Hope you get your portion of the flights without any trouble.    Don't push him about hotels until you get that back as you say, he could block you.

    Write it off and move on - you were going to lose the money in exchange for a holiday anyway, you just didn't get the holiday.

    Firstly he does have the money, earns plenty.  Secondly £704 for the hotel and over £600 for my flight is hard to write off.   I don't earn much and this was a once in a lifetime trip.    Thanks for the small claims suggestion, but I only have a phone number for him now as he has moved.  Do know where he works though.
  • As infuriating as it is I tend to agree with mattyprice.   This could turn really nasty especially if you involve his workplace (never a good idea).    Hopefully your ex will have a conscience and refund you half of what he gets?  But then again if there is bitterness there he might not in which case be glad you got shut and move on.  Apologies, not meaning to turn into 'agony aunt'    Good luck with whatever action you decide.

    Threaten to take legal action if the "friend" won't do the right thing.  The threat alone may be enough ... if not, get legal advice and carry through the threat - no point making a threat of this kind if you have no intention of following through.  If the ex-friend has recovered the money and not returned your share to you, then it would be theft, which isn't a Small Claims Court matter, it's criminal.
