  • There is a big difference between a paperless direct debit and a signed DD mandate, I haven't worked in this area for a few years but a paperless set up had no limit on indemnity and at any point a person can call up and say 'I didn't authorise that transaction' and the money will be returned, however if it is a physically signed DD mandate then there is a time limit (I cant recall how long but a year or so from memory). So its very likely these refunds are being made under the direct debit guarentee

    If payments made more than six years ago are in dispute, then the claimant is statute barred from making a court claim as per my previous post. Whilst the debt can still (allegedly) exist (in England and Wales), there is no legal requirement for anyone to pay it. 

    I'm not sure about the law in NI, but I believe the debt ceases to exist in Scotland after five years.
