In which case, yes I would have thought he could claim.Bobtail123 said:Thank you for your comments - The financial order will be sorted once the decree Nisi has been announced. We were only married for just under 3 years and the only other thing on the table is his pension (I have only just started to pay in to my pension within the last couple of months - He works within the emergency services and has been paying in to it the whole time we were together. I am not bothered by the pension, I don't want it as I'd rather have a clean cut and get on with my life.Forty and fabulous, well that's what my cards say....0 -
It doesn't make sense to preempt the financial settlement by dividing up the marital assets in the hope that the early division will not be readjusted in a future financial order.0

If he tries it on for the house, I really suggest you go after the pension - his will be gold plated and probably significantly more generous than the one you've only just started paying into.
If I were him, I'd want the financial consent order to protect his new property and pension from a claim you might make - perhaps if you realise your savings/pension aren't enough for retirement.0 -
As you have only been married for three years, your marriage will be deemed as a “short” marriage lasting less than five years, the court may deem it necessary to issue what is called a clean break order. A financial clean break order basically means each party leaves the marriage with whatever they brought into the marriage.
