I'm wavering a little, I could use the cash Wonga offered me right about now but the principle and stubbornness in me is not allowing me to weaken at the moment, getting pretty frustrated with the toothlessness of the ombudsman, although good and sympathetic to me it feels like they are happy to just wait around with out really proactively chasing wong & move my complaints forward.

How did Wonga make their offer to you Fusion? was it via e-mail (just out of curiosity) as i'm constantly checking my email to see if i've had a response!

It's a difficult one for you as if Wonga have offered you a figure, the amount you could get back is probably significantly higher!

Im going to have to go against the grain here regarding bank statements.

As it you who has brought the compaint, the onus is really on you to prove that the loans were irresponsible. In many cases, the lenders arent responding or providing any evidence.

Without bankstatements, the FOS have no evidence of income and expenses, which makes it quite difficult for them to assess whether a loan was affordable or not, and by not sending them when asked, you are not cooperating with the adjudicator.

You adjudicator will have hundreds of other cases, and just doesnt have the time to look for clues- you need to supply as much evidence as is humanly possible, to help them to come to a decision as quickly as possible. If you dont cooperate, and your lender doesnt cooperate, they have nothing to work with.

Your adjudicator needs to know your actual income and expenses. You could tell them that you earnt £800 a month, and your Wonga repayments might have been £600- clearly unaffordable. Without your statements, the adjudicator doesnt know whether you earnt £800 or £8000, which makes it much more difficult to make a decision on your case.

By not sending them, you open yourself up to unnecessary delays, and possible rejection. Where ever possible, send everthing you are asked for.

To be fair, not all adjudicators are asking for bank tatements, mine certainly didn't.My credit report was enough for him,and QQ certainly havent asked for them either.

they sent me an email, with about 2 weeks into the six week period, I've been emailing them weekly as well.

they are standing stubborn on it but I have enough information and laid my case out too. just frustrated...

Thank you for responding, I'm in my 3rd week of the extra 6 weeks now, it's very frustrating as I haven't heard from an adjudicator from the ombudsman either, hate all this waiting around!

Oh, if they dont ask, thats completey different! They obviously have enough to make a decision without them which is usually a good thing!

I just dont much point in refusing to send info if they ask for it... It is very unlikely to help your case if they say they need to see them, and you refuse. You're asking for their help- if they ask you to help them to help you, its a bit silly to say no :)

All cases are different, as I keep on saying, start off not expecting anything back and be prepared to wait at least 6 months for a resolution/outcome to your complaint. Nearly two weeks since my adjudicator found in my favour with PDUK, I have heard nothing since, PDUK are most likely to be digging in. Im off on Holiday for 3 weeks, I am hoping the position will have changed on my return.

Interestingly, I just went onto the Wonga website to get their complaints email address to chase them again and the website is down for essential maintenance..... Hmmmm!!!
  • My adj' didnt ask for anything I just supplied a credit report and he upheld my complaint from there.
My friend has been asked for bank statements straight away.
I agree helps to have all the info ready upfront.

    Hello all
Long time no speak :) re bank statements- my adjudicator wanted everything but I did refuse to send statements for one account- not my main account where my wages were paid and the loans came out of and into I might add- she sent a snotty email demanding '6 months bank statements for this account before and after each loan' and gave me two days to get them to her! I sent her a polite email saying enough was enough, I couldn't get these statements as the account in question was subject to a very messy wrangle with Wescot and RBS wouldn't speak to me about it; I said if she really wanted them if she could wait I would try and obtain them; I also pointed out politely that the transfers to this account only happened for about a period of five months and the account was only operational for about seven months in total from February to September so I couldn't provide this anyway. Lo and behold she didn't uphold but she was a nightmare!
So anyway- PDUK made me an offer. They said I shouldn't have been allowed to defer the last loan 8 times. It's currently with FOS but I am going to accept. The amount is a good amount- almost a months benefit money and I'm too unwell at the moment to go through all the hoo-hah they will inevitably cause. I do still have Payday Express and Sunny with FOS and I did ring the complaint in about the Money Shop but the forms never arrived so I'll have to give them a call about it. Feeling a bit more positive- this is a decent result. It was just a small loan (I think it was £200) but it was deferred a silly amount of times- 8 pages of deferrals on my credit file!!!
