Hi,
We inherited a property and there was a past boundary dispute between our relative and the neighbour.
The police were involved, solicitors etc. since our relative passed relations with the neighbour have been good and they were friendly to us.
Will the past dispute cause an issue when selling? Do we have to disclose it? The neighbour is selling too.
Thanks in advance.

Form TA6 asks2.1 Have there been any disputes or complaints regarding this property or a property nearby? If Yes, please give details:Are you selling as owner or Executer? ie has the property been transferred from the deceased's name into your name (as implied by "We inherited a property...").If you are the owner, it appears from what you say that you have had no disputes. If you are selling as Executer, then strictly speaking from what you've said the answer is 'yes', since the deceased had a dispute. However, as Executer you might well not know of this so might answer "None so far as is known"............

As greatcrested says, the extent of your knowledge as an executor is not expected to be extensive, so the answer he suggests would cover your fundamentals.

Has the dispute actually been resolved in a recorded way? Is it likely to resurface with new owners?0
