Read what Pete Wishart MP said recently in the House of commons about Smart Parking.
"I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.
…
The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices.Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Dear All
I hope you are all well and safe.
I read the information and followed it as you advised. I didn't receive a response from the hospital service.
I have received lots of debt collector letters since I last posted but I have ignored them as the information advised.
On Saturday I received a letter from CTS law headed lettera before claim. It gives me 30 days to reply and has a lengthy questionnaire attached to it for me to complete.
I have re-read the information and I'm unsure whether the letter is a debt collector letters which I should ignore or if I need to reply as the the letter states.
Any help will be really appreciated.
I'm really worried about a court claim as I really don't have £170.00 plus any court costs to pay.
Hope to hear from someone soon. Thank you.0 -

Write again, do not telephone.
Have they added an unlawful £60? If so. read thisExcel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.
and copy the correspondence to the SRA, it is time they put a stop to this deception by these cut price law firms .

Why not just read the CST Law group thread and stop panicking about a letter we've got so bored about that we created just one thread, to save repeating ourselves again and again...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Dear D_p_dance, Ralph y and Coupon -mad
Thank you for replying.
They haven't added an extra £60, the £170 is from debt recovery plus which is the original sum and additonal sum for not paying within the limited time.
Do I still send the letter you suggested?
I read the newbies thread. Sorry for asking what might be a simple question but do I have to submit a SAR or submit a defence template?
Also I had to search the forum since submitting my query yesterday and only just managed to find my post and your responses. Is there any easy way of finding replies and my post? Sorry I'm new to all of this so your help will be really appreciated.
Thank you for your help again and if it's any help I can submit a copy of the letter.

ThanksPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
