No, not a court "stamped letter". A court claim form. It will be a crappy print out.
OR come back if you get a letter before claim.
Your credit score can obviously not be affected unless you lose a court claim, because thats the "J" in CCJ!3 -
They are also ringing me, how did they get my phone number. Im guessing this can be seen as harassment.Yes. Block them. If they get around that with a new number, tell the debt collector the debt is disputed and denied and they MUST return the file to the parking firm and stop harassing you immediately.I am worried about my credit score. Hi All,
The recent status of my progress in this is i received a letter of claim from BW Legal dated 11 December 2020.
I have sent off a SAR to PPS and informed BW LEGAL of this. BW LEGAL have acknowledged this and given me the 30 days however nothing back from the SAR yet.
Reading through the next steps i have a bit of anxiety because the defence seems to be quite focused on inadequate signage etc. Annoyingly the road leading up to the car park and the entrance have got rather clear signage.
I'm just wondering if I stand a chance using the defence template and process?

If you research SAR, you will find that companies have 30 days to respond. If PPS are outside of this timescale, send them another e-mail giving them 7 days to respond else you will report them to ICO. If they are inside the 30 days, just wait a bit longer.
What else will you use as a defence? This goes in paragraph 2 & 3 on the template defence.2 -

Whether these points are valid to be a defence, i was thinking the following:
1) It was mid may, most lockdown rules were in place so the car park was almost empty. Hourly cost to park is 80 pence. Therefore my staying there 15 to 18 minutes over my time cannot create "damages" to the amount they are asking for. Realistically i did not prevent them from missing out on a "sale" in my overtime period.
2) Are there any rules on "grace period"?
I have attached pictures of the signage. Top picture is sign next to pay and display machine. Bottom picture is sign at entrance to car park.

You cannot argue "no loss". You need to decide why you did not P&D. No one can make that decision for you. You can try signage but you have posted some pretty clear pictures so that might be a non-starter. Everything else is included in the template defence which you will find as one of the first five threads on page one of the forum.2

Do you mean in fact that it took you, say, 9 minutes to find a space, park and go over and read the signs and pay at the machine or by app, and then no more than 9 minutes to exit after expiry of paid-for time?
Or are you saying that your ticket expired at, say, 1pm and you drove past the exit camera at, say. 1.18pm?
Why are you not in the habit of simply covering your rear numberplate when driving out of private car parks, as many people do? Not unlawful.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Funny thing is and im not sure whether this is in my favor, recently visited the place again to see if i could find more info / evidence and the car park in question has the builder fences surrounding it with a sign saying permanently closed.
I have also got in contact with so many different places to find out who the landowners are and nobody seems to know.

However i am interested in seeing the results back from the SAR as im wondering if the cameras are on the stretch of road before the entrance (its hard to tell in the picture in my intial letter and i cant remember from my walk about the other day). Reason for this curiosity is the car park is a turning off of this road, i could argue i left the car park and "turned right" to view the new housing estate being built before turning around and exiting . . . . . hmmm food for thought. I will revisit the place tommorow to see if the cameras are still there.
I did not know covering you licence plate is an option? I will do that all the time now!
