Injury due to brand new shower head striking my forhead

I had a brand new shower cubicle built, it was completed a month ago. 2weeks ago as I turned the shower on the large square shower head came off and struck me on the forhead, and also made 2 holes in my brand new shower tray. I had a cut and lump on my forhead, I rang my builder who had done the work, he said he would fill the shower tray with filler, no apologies for my injury, the blood was still running down my face when he arrived. I said I wanted a new shower tray, he said not his problems! Any help please

Was the shower head fixed, ie was it one of those rainforest fixed ceiling ones that you get in some hotels? If so builder should make it right and if the damage to the tray is substantial either get the builder to replace it or if they are unwilling go down the LBA route as above. If it was one that could be removed to use in the hand then I suspect the argument would be that it was just not returned to the holder correctly and would not be the fault of the builder.
