How do I challenge an Excel Parking fine?

    When the eviction ban is lifted shortly I cannot see courts being very pleased with this type of spurious claim. Hopefully they will make examples of the PPC  by awarding costs for unreasonable behaviour.

  • Just to keep you in the loop:
    Returned from holiday last night and found 2 letters, both from Excel Parking.
    1 seems a fairly standard one stating that they are "willing to accept a reduced settlement charge of £125.00 payable within 14 days from the letter" (3.8.20).
    However, another one dated 31.7.20 stated that:
    "We can confirm receipt of your standard internet Defence.
    We must advise you that the case of Britannia Parking Group Ltd v Semark-Jullien (heard with Mr Crosby) has now been set aside by HHJ Parkes.
    Therefore your Defence surrounding debt charges is bound to fail."
    That last sentence is both threatening and arrogant in the extreme!!!
    I hope that I have followed the newbie information correctly in terms of attaching the correct documents in my Defence. It seems a little strange to write twice to confirm that they have received my Defence.

    Just remember that parking scammers are, well, scammers, and they tell lies.

    The case they refer to was a joint case with another motorist (Crosby) but they only appealed against the weakest case which was brought by a FMOTL nutter gentleperson. 
    The abuse of process decision for Crosby still stands and so do all the other findings and strike outs for abuse of process up and down the country.

    When they send this type of letter (first letter) it's often the forerunner of a discontinuance.  

    Do you have any collection letters from DRP or Zenith. We have evidence that these collection agents work on a no collection, no fee basis.

    This looks like another Excel claim that will either be discontinued or dismissed. Some of their claims that are appearing on this forum smack of sheer desperation.

    The courts won't be very happy as they will have to deal with a backlog of genuine claims, evictions, molestation orders, etc.

    The easy victim's case was appealed and the outcome wasn't what the industry were hoping for - and Mr Crosby's case still stands.  This is just pathetic.

    Even if Excel had not added on the £60.00 (that they never pay out) your defence is still strong and well they know it.  Many judges look at the contract element of the claim and you had fulfilled the terms of the contract.
