The question was: "who does it suggest you pay?"

Hello and thanks a lot again for all your help,
I had send an email to Gladstone and informed them that they have failed to meet the requirements of the PAP two months ago, and now they have replied me without mentioning anything regarding this, they have provided me some photos of my car and wrote this:
"In the event that payment is not made nor do we receive a substantive response within 14 days from the date of this email, our Client may elect to issue legal proceedings without further notice to you."
Would you please advise me on this.
    Many many thanks,
Are you sure that's from Gladstones? Who does it suggest you pay?

As they only give you fourteen days for a response, that letter too is not a compliant Letter of Claim.
The email is from Gladstones and they're asking for the same amount £320.

We asked who it asks you to pay?  Gladstones, or Debt Recovery Plus?

I am not sure what you need to know that's not already covered in the NEWBIES thread post #2.  You KNOW that you are going to get a court claim, so you should be expecting all this ore-action posturing and be waiting for your claim form!

No need for more advice.  Read the NEWBIES thread.

Please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    https://standardsdevelopment.bsigroup.com/projects/2020-00193#/section

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/913272/Code_Enforcement_Framework_consultation.pdf

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!

  • Hi,
Another letter from Gladstones. They've given 14 days for paying the full amount. Gladstons has asked to pay them.

You already know that a letter that offers you only fourteen days to pay is not a valid Letter of Claim.

    But that's fine - I notice you haven't asked a question.   ;)

Thanks for your reply, I'm a bit confused after reading the newbies thread, so do I have to wait for the "Letter of Claim" and eventually attend the court? If I loose do I have to pay the full amount plus the hearing charge? Sorry but for someone that English is not her first language, I don't quit understand all the legal terms and abbreviations used in the Newbies thread. In addition I'm worried that I couldn't defend properly in the court. Should I ask them to reduce the payment and make life easer?

No!  DO NOT TRY.  STOP WORRYING.  They won't do that and it shows you are a victim who hasn't a clue that this isn't a fine and that you are likely to win in court.  Wait for the LBC, this 14 days letter is just a debt demand and the sum of money has been inflated.

If you have already asked the PPC for a SAR (have you? as per the NEWBIES thread) then you have everything you need.

  • Yes, I have reported them to SRA because they've asked for the payment within 14 days after their letter was issued.
