Unpaid PCN


I received two PCNs last year. One of them was issued more than 14 days after the incident but the other one was within the 14 days. They were both asking for a discounted charge of £60. I was told by the company I was visiting that I could park at that location. Now I have received a letter from Gladstones Solicitors in order to pay them £320 regarding the unpaid PCNs. Should I make a response? Would you please advise me on what to do? Thanks a lot

Depends if the letter is actually from them or a debt collector ?
Does the reference number start with a 1 ?
Does it say to pay Gsl or some other entity ?
Did it give 14 days notice ? If 30 days notice and include financial forms ?
Which nation are you in ?
Which parking company issued them ?
I have no idea how you expect us to answer your legal query with such sparse details !!

Nine times out of ten these tickets are scams, so consider complaining to your M,P., it can cause the scammer extra costs, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

The letter has Gladstones Solicitors Logo on top.
The reference number starts with one.
The PCN was issued by CPM (UK Car Park Managment).
I'm based in England (London).
They have asked to pay Gladstones in 14 days. (Due by 10th of July).

Giving you fourteen days means it is a debt collector letter. If it gave you 30 days and included forms asking about your income, which you do not fill in, then it is a LBC.
Edit your posts to remove information about who did what. If the PCNs are non PoFA compliant (and we know one of them is) then the driver's identity should never be revealed, not even on here.
Only ever refer to The Driver and The Keeper, who are two different people as far as the law is concerned.
What happened when you complained to the landowner/business being visited?
Have you complained to your MP yet about this unregulated scam?
Get pics of the site and signage. Use Google Street View in case they show the entrance and signs around the time of the alleged event.
Get stuck into the second post of the NEWBIES and the guide to court written by bargepole that you will find there in anticipation of a court claim.

Report that letter to the SRA please, complaining about Gladstones.
I've seen that letter off-forum and it lectures the recipient about the pre-action protocol and is headed up 'LETTER OF CLAIM' so it needs reporting to the SRA because it misleads the recipient about CCJs and bailiffs and fails to allow the 30 days required, under the very PAP that they tell the consumer about.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Respond back, informing them that despite this being titled "letter of claim", this is no such thing as it compeltely fails to meet the requirements of the PAP for debt claims
You require a properly formatted letter within 14 days, else you consider the matter clsoed
Inform them you have already reported them to the SRA for their clear and obvious breach of the professional duties imposed upon them, and their response to this letter will be added to the complaint in due course.2 -
Hello and thanks a lot again for all your help,
I had send an email to Gladstone and informed them that they have failed to meet the requirements of the PAP two months ago, and now they have replied me without mentioning anything regarding this, they have provided me some photos of my car and wrote this:
"In the event that payment is not made nor do we receive a substantive response within 14 days from the date of this email, our Client may elect to issue legal proceedings without further notice to you."
Would you please advise me on this.

As they only give you fourteen days for a response, that letter too is not a compliant Letter of Claim.3
