Parking Charge Notice

Eratn said:Hi, need an advice for a Parking Charge Notice, which is probably already answered in many ways before.
I am an IT Mobile Engineer, who visits homeworkers of some financial establishments. When I visited a homeworker at their residence, apparently my "car" (not a van) has been clocked , taken photos of and a Parking Charge Notice has been issued. This has apparently done by an enforcement on foot officer of this company, CPM - Uk Car Park Management. The strangeness about this is, yes I've been there, but the notice shows the time as TWO hours after I left there. So, there is a clerical mistake in there. We do have pictures with our mobiles, get a form signed by the customer etc. When it comes to proving that they have got the wrong time, I can't show these photos or the signed form with that confidential data on them. How do I go about this? Thank you all who replies for your valuable advice. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi all,
Update on the above. The keeper responded with the one size fits all template which didn't say who the driver was.
I have received a response (which I have filed in the following folder alongside all the signage photos and the initial NTK https://www.dropbox.com/sh/0667592vzqq7yoy/AAAPDb1S4LF2G4q5e_MFlsQka?dl=0) from PCM who have said the driver contravened the terms and conditions for the use of the private land on which it was photographed. And that the advertised terms require vehicles to be parked wholly within the confines of a marked bay - whether they are marked by traditional white lines, differences on block paving or 'T' markings.
Having looked very closely at the pictures I think my front tire is over the dotted line and therefore parked in two bays. However, the workmen who were changing the signage on that day were parked in front with a van exceeding 2 spaces and with the van doors open meaning it was not really possible to get into 1 space.
The next step that the keeper is being told is appealing to the IAS.
If any of you fantastic people who are on the forum would be able to let me know what I should be doing now that would be great, having read the main sticky it suggests I don't appeal to IAS? But wondered if there is anything there that the keeper should be doing differently in my case to other cases given what people have said above re: the signage at the location saying 'no stopping' and having double yellow lines.
Thanks all as always!!0 -
FIzzy - this is not your thread. Delete that post
I wouldnt appeal to the IAS.3 -
Thanks guys. So next stage would be not to appeal to IAS and then just see where this goes? Unfortunately the keeper really doesn’t want to have to go to court to defend therefore I wonder if just better to pay up now even though the driver doesn’t seem to have contravened any t and cs.
thanks

you should have expected a rejection, there is no profit in acceptance , rejection was inevitableif it goes anywhere, its to court within 6 yearscheck if the claimant complied with POFA , or notif not , the keeper has no liability, if yes, the keeper could name the driver and remove themselves from the equationthe driver can then defend their own actions , including using the story above , in courtnot sure why anyone of you is afraid of court, its civil court where the legal arguments are thrashed out, if the defendant loses , they pay up to £200 within one month to avoid credit issues. its not like they deport you or put you in prison or skin your cat !!!its a dispute about contracts and owing moneyno wayyyyyy would I be paying sc@mmers1

Coupon-mad said:Also I noticed the signs for parking were being changed by some workmen during the 5 mins of my car being stationary in the spot.Do you have dashcam proof? If not, go and get some new photos to prove the signs changed.
Was this at a residential site where the resident shouls be complaining to the Managing Agents who contracted PCM? Do that first.
The try an appeal as driver - yep - (NOT THE TEMPLATE APPEAL IN THIS CASE) and then an IAS appeal - because it's PCM and because you will have evidence of the changing signs.
Why do you think I put it in bold? I say this clearly on threads where I can see a possible win. I said it to you so no need to read generic advice about NOT appealing to the IAS in the NEWBIES thread that was also written by me!

Hi wondered if anyone has any advice re 4 x NCP I have received.I have recently started using NCP car park for work but decided to use the Ringo app to pay!! However after using it a few times the cost suddenly went up by £2. I queried it with Ringo but to be told they don’t provided the service for the actual NCP car park I was on! It was then I realised I had been paying for the council car park next to the NcP!! The Ringo location services had picked up the the council car park next door and I had been paying it 😞. As soon as I realised I contacted NCP car park who opened a case file but said there was nothing they could do but advise I appeal the fines as they come through as I have proof of intent to pay by uploading the receipts from RINGO. My first appeal has been rejected 😭. I let them know I was parking there as doing extra hours as a key worker. Not sure whether to take to POPLA.I’ve now received my next PCN And I am waiting on another 2, does anyone have any advice on appealing them.
