In my case the judge did give Excel the right to appeal. They did not appeal.
Thanks. Out of pure interest only, on what grounds did they propose to appeal?

Well done on that win. Seeking to appeal is an almost automatic knee jerk to any Excel/VCS court loss. They really are bad losers, and can be traced back as far as the Martin Cutts case when SRS described the court ruling as ".....an embarrassment to the judicial system" and he made some pretty rude remarks about the judge DDJ Lateef, describing her as "not fit to serve the civil court."
They very rarely appeal, so I wouldn't lose much sleep over that threat.(Removed by Forum Team)Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.6 -
The Elms fella in my case told the court that they are instructed to ask for permission to appeal in every case. That seems to me to be an abuse, but the reality is that it often just looks stupid.
An appeal seems unlikely if to do that they need to go beind the relevant code of practice6 -

SRS is a bad loser and he must accept that nowadays he is going to lose, his business model dictates this. And when the new CoP comes in, SRS will struggle and could well lose all access to the DVLA. As my old headmaster would say .... "BUCK YOUR IDEAS UP LAD"

I can't understand why VCS are such sore losers!? They have wasted far more money and time than they were ever set to make! It's actually rather perverse and vindictive. They are like a dog with a bone and can't let go. It's strange and they would make better time binning it off, cutting their losses and processing other PCN threatagrams as the majority of people pay without contest! They must be desperate or spiteful or petty - or all the above! They has a hissy fit about the parking bill on their Excel website and it is their attitude and behaviour which is bringing on the much needed changes!
Well done Lyndon5 -

That's what they hoped it would achieve- but it backfired and once again ended up with egg on their face! It's almost as if they enjoy being humiliated! They love dishing it out - but when the shoe is on the other foot they whine like a b***h!!!
Let's see how their business model fairs up when the new bill is finally passed. Hopefully karma will prevail.4 -
Pedant alert - the bill is already passed; it's just awaiting the finalisation of the Code of Practice and setup of the new appeals body. So it's basically waiting to be enacted.Jenni x4
