Glad you mentioned that then as I thought it was just a letter for the Judge/court. Will send to VCS as well.Not really sure what VCS are up to or intend by not doing a WS.0

It is always good policy to follow up a phone call (bearing in mind a phone call is worth the paper it is written on) with an e-mail confirming the gist of the phone call and any outcome.6

I have used this strategy for years, it can be a killer.You never know how far you can go until you go too far.3

Just an update - My son checked with the court late this afternoon (5th Nov) and they haven't received the WS from VCS so they have definitely not complied as it had to be there by 4pm 2nd Nov. VCS have though paid the £25 court fee, apparently 10 days before that deadline. The court did tell him they are a couple of days behind in opening the post and that the judge will be automatically notified after a number of days if a deadlines passes (I must say the Sheffield court seems very good at dealing with this kind of stuff over the phone) but the fact my son hasn't received their WS and it is now 3 days late suggests it won't be there so he will send the email as suggested to court and cc: to VCS.4

Bear in mind VCS have a habit of stating that they haven't received documents etc , so be aware of this if they try to say so on the day and want an adjournment. Their system for receiving litigation etc is appalling , especially in these days of emails and instant communications5

The court have confirmed they received it OK, and my son got the auto response back from VCS litigation email address so I would hope that is enough proof.The fact the the court hasn't received their WS I would hope is damning enough and my stance would be to reject an adjourment and award costs being as they have failed to send in their WS to court and ours is there.Just as additonal bit of info, he had also send an email both to the court and to VCS asking if he could send the WS as a PDF by email. The court responded straight away saying it was OK. No response from VCS. He also asked for confirmation they had received the WS. Again court responded, VCS didn't. Shocking way to behave, but I think it is deliberate to pile pressure on defendants and put them off guard and try and sway the courts. They should not be allowed to get away with it.

This is typical of VCS .... Renshaw-smith runs VCS and Excel and we know their model is down by 80% plus, due to covid. What we don't know is how many staff he had laid off which would explain why there is incompetence.

It's obvious that Excel and VCS are having problems with the administration. Like Beamer says there are probably a lot of staff on furlough. SRS may have furloughed himself if he pays himself a salary on PAYE.
SRS is also involved in the hospitality sector so a double whammy. What a shame. Never mind.
