Bailiffs Letter


About 2 weeks later a PCN arrived. I immediately phoned the hotel and explained and I was asked to email the hotel management with the circumstances, which I did. A few weeks later, another charge letter arrived etc, they were all ignored as per advice relevant to Scotland, which is where the Hotel is located, read here previously. The letters stopped.
Today a letter from DCBL Bailiffs has arrived, a Notice of Debt Recovery, which is quite terrifying for normally law abiding folk with no debts.
What course of action, if any, can the Forumites suggest please.

Turn the letter over .... does it say this is not subject to bailiff action.

Oh, Yes it does. Sorry I panicked and didn’t even turn it over. It says the Liability for this charge in Scotland is ‘The driver of the vehicle on the date and time of this PCN being issued is responsible for payment.That information has never been disclosed.Also states ‘This case is not subject to High court or bailiff action’ Capital letters are where they have put them.Thanks again for calming me down, my other half is in hospital at the moment with heart problems so I’m anxiety central at the moment.2

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

ParkingEye have never started a claim in the Scottish courts. Expect some debt collector threatograms, but complain to your MP and ask them to write on your behalf, to the Hotel and ParkingEye, who will respond and they will probably back down.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
