Flexible Furlough

Hi I have been on furlough since 6th April. My employer has asked me to return back to work on a part time basis I'm still on furlough, to date I have worked 2 days last week and they have asked me to come in on Monday.  My question is Martin showed an example of how the part time furlough system would work (screen shot below) and this shows that Ivor (example used) came out with a little bit of extra money on top of his furlough money, is this still the case I asked my Manager for advise and his reply was no i don't think you do but if you do "happy days", obviously this wasn't the reply i was hoping for and i just would like confirmation and to know where i stand on this.

    Martin is correct - your rate when working should be your full wage, and your furlough the 80% - so assuming your employer hasn't been 'topping up' your furlough themselves, you should be more by going back on flexible furlough. 

    Bear in mind some employers have 'topped up' furlough with the other 20% themselves, of course if they've done this then your wage will be the same.

    You will always be better off working than on furlough, unless as per the previous reply, your employer was topping up the 80% to 100%.

    If you're asking whether you can somehow end up with more than 100% of your usual wage, i.e. 101% or 120%, etc. then the answer is no.  If you're asking whether you will definitely end up with more money than sitting at home or on the beach, the answer is yes.

    I would not worry about your line manager's comment, because it is clear he does not know the answer or mis-interpreted your question.
    Assuming you work a regular 5-day week, then last week you will get:
    2 days at 100% (worked)
    3 days at 80% (furlough)

    Next week you will get:
    1 day at 100% (worked Monday)
    4 days at 80% (furlough)
    Unless you end up working more than just Monday.

    This is the type of flexibility that the scheme is specifically there to support the ramp up from zero to full load.

    To sound a note of caution, many employees had their salary cut to 80% while on furlough, but some had their contracts of employment amended to reduce pay to 80% whether on furlough or working, at least in the short term. You should check your contract of employment as amended by the furlough agreement. What are people who are working as opposed to being on furlough at your company paid?

    Thanks so much for your replies i really appreciate your help. Having read my contract of employment as amended by the furlough agreement I am a bit confused where i stand now.  Can anyone help please extract attached.  Thank you

    Well they will need to update it to take into account the changes to the scheme.

    "Given the unprecedented position regarding the Coronavirus pandemic and a consequent downturn in our work, we have decided that the appropriate action for the company is to reduce salaries by 20% and to 'furlough' some staff for the time being"

    I am not clear whether this means all staff salaries have been reduced to 20%, or just staff while on furlough, but it looks like all staff to me, which means you would only get 80% even when working.

    Sorry to bother you again!! but since last Thursday I have been back in the office every day and I have stillnot received a new Contract of Employment.  I have chased two of the Managers for the letter, 1st response yesterday "I'm not sure about a letter i will look into it for you" 2nd Response today "we are asking our Solicitor about the letter".  My question is should I actually be at work without signing a new contract?  I have not received any consultation before going back into work and they are just telling me at 5:30pm to come into work the next day. I have looked on .gov and i know I need to sign a new Contract but nothing states that I shouldn't be at work without signing the letter.  I have also sought advice from Citizens Advice but to be honest they were useless and just copied and pasted 12 links!!!

    There is no requirement in law to have a written contract of employment, although it is best practice. A furlough agreement does have to be in writing, although agreement to it does not. Are they able to answer the simple question as to whether you will be paid 100% or 80% for days worked?
