Presuming they are full time employees working 37.5 hours a week if anyone over 25 was earning less than around £21300 before the furlough agreement was drawn up then they cannot return to work unless their full salary is reinstated (at least for the hours they work), otherwise it would be a breach of the minimum wage act.0

I have received the response as below:
as confirmed in email of 2.4.20 and my letter of 3.4.20, your salary (as was everybody else’s) was unfortunately reduced to 80% as a consequence of the global pandemic and downturn in our workload. When working under the flexible furlough scheme, you will be paid based upon 100% of your reduced salary, but calculated to reflect the exact number of days and/or hours actually worked. This calculation will be handled by our Accountants in the usual way, however you can always speak with me at any time, if you have any queries whatsoever.
Regarding the flexible furlough scheme, following guidance received from our Employment advisors, there is no need for us to confirm in writing the transition from furlough to flexible furlough working arrangements. However, in order to maintain an accurate record of the exact time you spend working on a flexible basis, we will be asking you to sign and agree a spreadsheet which will record the time you spend working each month. This is simply to keep an accurate record which we can share with Accountants on a monthly basis, and will help us evidence the time staff work during a flexible furlough arrangement should HMRC ask us for proof.
