    A debt recovery company CANNOT* take you to court ... there is no alleged debt in their name that you could possibly owe. NCP could take you to court, and they could engage a legal company to do it for them, but TRACE could not take you to court in their name.

    * Well, anyone can take anyone to court if they wanted to - but they'd have no case that they could prove.
    Semantics.  Trace work for their clients in the same way as any debt collection agency has done for decades.
    But they're not a legal company (to my knowledge) despite their name ... they're merely a debt collector who do not actually have a litigation department with a supervising lawyer and so cannot raise legal action on behalf of a client. So no - not just semantics.

  • Correct Jenni

    There are debt collectors and then we have the rest.
    "THE REST" work the private parking industry without a clue what they are doing

    Hopefully the new code of practice will will trash these jokers who lie through their teeth

    I guess, let them have their fun ... it's now time limited

    @Coupon-mad's post surely answered that...
    Clearly this is just a debt demand which you can tell from the 14 days.  This is explained in the NEWBIES thread 2nd  and 4th posts.
    I too suggest you read at least the fourth post of the NEWBIES thread.

    But Joe, if you have further questions you are best advised to start your own thread as trying to deal with the different problems of two different people will certainly lead to confusion.

    And to answer your question - yes.

    But there is no debt here, so what do you mean by lying and bullying

    Well, Trace and NCP are being investigated by the BPA now for this misleading letter and job title/department name, and if that doesn’t resolve this then it will be taken further.

    This is not acceptable from a bottom feeding self styled PCN Debt crawler.  They wanna survive next year under the new framework?  They need to clean up their act.
    Trace have been claiming this for the last couple of years, they have always claimed to have a "litigation manager", yet when challenged they go all coy

    Okay so after posting the picture of my letter I’ve now received this text message, I’m not even sure how they would’ve gotten my phone number to begin with?
