Insurance Claim Not at Fault

Without dash cameras front/back/sides it will be 50/50 at best - assuming your daughter was in the correct lane and didnt cause the accident.1

The sign is a long way back, but it suggests that the third exit is to be treated as being at 1 o'clock from the approach road. As such the left hand lane should only be used for the first and second exits.

I think your daughter was definitely in the wrong lane and the other driver should really be in the left lane. But accepted usage may suggest that the majority use both lanes for the second (dual carriageway exit). I suspect that the boss was probably showing off a little and the young lad was trying to keep up. I think 50:50 is the best she can do in the circumstances.
Strange roundabouts can be worrying, you think you have made the correct choice but common usage dictates otherwise so you just have to keep your wits about you.1 -
So she joined the roundabout up this road...

She came in on the B3400, the second exit in question is not only the primary exit, but a continuation of the road she was on, the B3400.
She was effectively turning right off the B3400 at the roundabout, into the third exit - an exit just after the primary exit, so minor it doesn't even justify a direction name on the signage.
She's lucky to be getting off with 50/50.1 -
If you go round the r'bout you'll see that LH lane is perfectly valid for taking exit 3 ... someone in the RH lane wanting to take exit 2 will have to cross the LH lane. As they would be the one changing lanes then the onus is on them to ensure it is safe to do so. (It would be no different to someone joining at No.1 and exiting at No.3 ... they would be expected to be in the LH lane). This will still go 50:50 though in the absence of other evidence.2

Do you think so, I feel the South Ham exit is 1o’clock but the little one in before it is straight across. Either way it seems that because it happened on a roundabout it’s 50:50.Ditzy_Mitzy said:The sign is a long way back, but it suggests that the third exit is to be treated as being at 1 o'clock from the approach road. That’s the signage we have & looking at she’s going straight across, but if only we had the Dashcam, if I had Dashcam I would be jumping at the chance to show it.AdrianC said:So she joined the roundabout up this road...

I would have chosen the right hand lane personally for turn 3, but equally, I would never be in the right hand lane for turn 2. Not ever, not unless I was trying to get in front of someone, not that I would in that manner. Personally I think the other driver is more at fault for doing this, but getting insurance companies to see it that way will be very difficullt.1

Don't get hung up on the precise angles. They're irrelevant. Look at the traffic flows.glitzy said:

1st exit - leisure centre
2nd exit - continuation of the main through route, two-lane exit, towards town centre and ringroad
3rd exit - minor ind est
4th exit - secondary through traffic
5th exit - minor retail access
6th exit - back onto main through route
Compare also the explicit road markings at the single lane exit 6/B3400 W with the lack of lane markings at exit 2/B3400E
