Footasylum exchange.

Hi. I haven't much time left and I would appreciate a prompt reply as Footasylum have emailed me about this matter. I sent my pants back to Footasylum and as they received it they saying they can't exchanged this because the sale for the pants has needed and it's on for the original price. I payed for it when it was on sale so under what power ( or the contract between me and the retailer ) do I have to get an exchange. Because I don't wanna pay a higher price for it as I've already played. This is what they said "I am emailing you regarding your Footasylum exchange. Unfortunately, the item that you require is more than the one item you sent back, at the moment we cannot take extra payments . Is there any other item that you would like for your exchange for the price of £(24.99 ) or would you prefer if I processed a refund for you? If there is another item that you would like please could you email me back with the product number and the size required. If I receive no reply within 24 hours, I will then process a refund.

Basically, Footasylum are within their rights here.
From what I can gather, you returned something because it was the wrong size and you wanted an exchange for an item of the correct size and this is more expensive.
For some reason they can't take another payment at present so they are giving you the option to exchange for something of the same value or to take a refund.
What they are doing is perfectly legal and acceptable.

Legally, all they have to do is to give a refund and anything offered beyond this is down to the company. If they don't want to offer an exchange for a different size of the item you returned, they don't have to.0 -
Do they legally have to refund the shipping cost I paid for too? Because I did send it before 30 days as stated in the contract.
