Netflights T&C's help...…..

Hi there, I have had a flight cancelled in March by Netflights.  They seem pretty happy to announce on their website that MY money was passed on to the airline and therefore I can only have a refund when it gets returned to them.  Well I have lost my patience with them like a lot of people by the sound of it.  I am now asking them on Twitter to advise me where it says in my T&C's with them that I need to wait until the airline refunds them.  They have pointed to something in Section 7 'Changes and cancellations by you' .  So I am now asking why they are pointing to this section, these are my T&C's so 'Changes and cancellations by you' is irrelevant because they cancelled on me.  Section 8 is where there should be looking.  If anyone on here is kind enough to read the netflights T&C's and perhaps understand them better than I for the scenario above I know it will help a lot of people out.

    The agent didn't cancel the flight the airline did and for flight-only sales, most agents make it clear your contract is with the airline, not them. It might help if you name the airline, then we can tell you whether it is fast (BA and Norwegian) slow (very) such as Virgin or non-existent, too many to mention

    Hi there thanks for the response, my contract is with Netflights which is why I have there T&C's to follow and have to ask them for a refund.  Its also why I'm asking them to tell me where it states about refunds.  I'm not sure they are pointing me to the correct place in the T&C's.  This is it:  Under Section 7 'Changes and Cancellations by you' (Me).

    Its TAP Portugal its in the non-existent bracket, hence me going down this route

    'If you need to cancel you must contact us.  Cancellation charges vary depending upon the services booked and will be higher the later you cancel. Except as described below in respect of car rental, a minimum cancellation fee of £50 will apply regardless of the value of the service cancelled.  In some cases it may not be possible to offer any refunds for certain services such as air tickets once a booking has been made.  The cancellation charge of flight-only bookings will be 100% of the cost of the booking.  Please ensure that you are certain of the fees applicable to your booking by asking us before proceeding to book your arrangements.  Air tickets returned to us for a refund are subject to an administration fee of £50 per ticket.  Refunds will not be paid by us until they have been received by us from the relevant airline or consolidator.'

    When you book a flight via an agent they will need to pay the airline, so your money is passed on and the agent gets a tiny % commission.  Here we are now where people want flight refunds, and the airlines are being slow in refunding the money.  The travel agents simply don't have the cash in the business.

    Also FWIW, you'd be in no better situation if you had booked direct with the airline.

    I know neither of these points really help you, and likely won't make you feel any better either.  But it's the reality of the situation.  You of course may have recourse via chargeback/Section 75 with your card provider if you want to try another method.

    You are now suggesting you cancelled, since you have quoted that part of the conditions if you did, there is no refund due at all. If it is as you originally suggested netflights can only refund when TAP do and as you have already suggested, and you can see by checking through the comments on this site, are one of the airlines who cannot find the cheque book

    Hi Alan, the bit I have quoted indeed suggests it was the customer cancelled ... I didn't. .  The bit I quoted and the reason I quoted it, is this is bit that Netflights are pointing too to suggest they don't have to pay out until the airline refunds them.  As you rightly point out this is applicable to when customers cancel.
    As yet they still are unable to point to anything in their T&C's that backs up their claim.
