What did your employer say when you asked them about the furlough payments?

  • she said that she was to get a code from hmrc but that has not happened so we are not getting any furlough money

Do you have a minimum number of contracted hours? Or are you one a zero hour contract?

Employer's claims for furlough money are made on the HMRC website using exactly the same login details normally used to access the PAYE payroll scheme. No need to wait for any code from HMRC.

You were legally entitled to that as a minimum. That is why your employer needed your agreeent to furlough you - it's not just you agreeing to work a minimum of 12 hours, it was your employer agreeing to provide a minimum of 12 hours. If you're available for work, they need to pay you regardless of whether there is work or not. You agreeing to 80% (assuming your employer did specify this - if not then technically they should be paying in full) was to lessen the liability that your employer would have otherwise had to pay you 100%.

Contact ACAS - they used to offer a mediation service but I'm not sure if that will still be the case, I imagine if so there might be quite the waiting list as employers bumble their way through the unknown rather than seeking professional advice.

I'd point out if they're letting go of all staff then the business might be going under, but as they're letting you go it's not like you really have anything to lose.

Unless your employer has previously claimed for you then the final date for new claims was 10th June. After that date you can no longer be furloughed. It's been 4 months, is there any reason why you've left it so late?
Is 12 hours a week what's stated in your contract of employment?

We never used the PAYE payroll scheme as we submit all our payroll info online using relatively cheap software, but to submit a furlough claim you do have to log into your gateway account as well as having the corporation tax code.

when we submitted our 1st claim, the need for a corporation tax code sent us into a tail spin but then realised it was basically our incorporation reference. If we hadn't realised that then yes we would have needed to wait for that code to come.

If you're paying wages to staff then you're using the PAYE payroll scheme. The software that you use to process the payroll will be using an HMRC login and password in order to upload the RTI information to the government gateway each time you run the payroll. It is that same login and password which is used to log in and reclaim the furlough money.  Probably someone typed it into the settings of your payroll software, let the software remember the password, but forgot to keep a paper record of it.
