Wells next the sea quay parking charge

So we parked in this car park whilst looking at the sat nav on a quiet day hardly any other cars there due to the weather, we decided to stay for a bit and have something to eat so payment of £4.50 was made via the phone and pay app which was suggested on the machine due to covid 19 handling cash touching machine etc, this took a while to download and also crashed a few times so may of gone over the grace time given, the reviews of this app even mention it crashing. We then decided to leave this car park and this was all within the space of half hour so I paid for a full day but only spent 30mins there. I've now received a parking charge from these bullys. I'm guessing I appeal but never mention driver and can this company civil enforcement take registered keeper to court over this? Thank you.

    Make sure the keeper appeals, not saying who was driving.  Read the NEWBIES thread.

    CEL can't hold the rk liable so the rk appeals, then wins at POPLA by pointing out that CEL can't hold them liable (easy!).

    Ther have been several threads about this car park and its stubborn ignoranr harbour master in the last year, do a search for them.  AFAIAA, the PC have lost/cnacelled all of them.  It would seem thaat this car park is covered by bye  laws and POFA does not apply. 

    Get your as nine times out of ten these tickets are scams, Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up,


    Just as the clampers were finally closed down, so hopefully will many DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
