    Then it shouldn't be a problem at all. I'd just mention to the conciliator that you want to add that onto your claim and increase what you're asking for to settle accordingly.

    You'll need to win your claim for the unpaid wages to also win the failure to provide written particulars claim.

    My employer hasn't paid my wages and holidays so after trying to settle this without any 3rd parties involved and failing to reach an agreement I decided to file a case to ACAS for unpaid wages+holidays. However, my employer has not given me a contract since joining in september nor any payslips or P60. I did not file a separate claim for this breaches but I was wondering should I have filed 2 separate files; one for unpaid wages+ holidays and another one for failure to provide payslips+contract? I'm too late now anyway I guess as it is 3 months -1 day? 
    I did mention that on the additional info section about the payslips and contract on the WAGES claim however if we don't come to an agreement and we go to employment tribunal could I claim compensation for that or they'll say I should have filed another claim for that?

    What are your losses for not having payslips and a contract? (as opposed to no wages for 3 weeks).

    I’ve stopped working there due to Covid but I don’t think I’ll be called back so No. I wouldn’t really know, maybe not being able to work holidays entitlement etc does that count? I wouldn’t really know

    Written particulars is the odd one out in that you have to win something else to win that, but you wouldn't need to win the claim for written particulars to win the claim for unpaid wages. If that makes sense!

    I understand. My main worry was whether or not I could add the payslips breach onto the wages claim, just so I could be compensated more eventually if we were to go to ET. By the way how long have I got from the moment conciliation period ends to submitting the ET1/ Employment tribunal?

    There's not too much you can do regarding the payslips unfortunately, ie you can't win anything, but I think it probably adds to your case if you think they're not paying you properly.

    And you get another month to make the actual claim following receipt of the certificate. But double check all this stuff.
