If you are to have a F2F hearing, it will be the first one for a while. Search the forum using "ring binder" in the search forum box and "Coupon-Mad" in the Author box (without the speech marks) and you should find some advice about how to submit the WS and evidence that @Coupon-mad wrote pre-covid.1

Read the newbies FAQ sticky thread again , plenty of advice in there
Read the telephone hearings thread by coupon mad , in case it turns into one , be it by telephone or by video link
Read previously concluded court case threads between 2018 and march 2021 , to see the advice on bundles in paginated and numbered exhibits in ring binders , the old method of submission to court and claimant , where 3 are prepared
Do what the court order tells you to do , but be prepared for emailed bundles because few cases actually see a court room due to covid19
Also check with court and claimant if emailed bundles in pdf format is sufficient or does it have to be paper only1

The instructions say I have to send my WS to all parties by 14th April and create a Trial Bundle in a suitable ring binder.I would question the need for a physical bundle. It used to be the case pre-covid, but since, almost everything has been done electronically. Check it out with the issuing court. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Are you sure it doesn't say the Claimant has to do the trial bundle?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I re-read it and yes you are correct, it's the Claimant. Once I have drafted the WS I will post it for comments especially as I will representing my wife as a Lay person. Thank you.1

Can you please confirm that everything has been done in your wife's name (not in your name 'on behalf of') and that she will be present at the hearing?mgmju411 said:I re-read it and yes you are correct, it's the Claimant. Yes everything has been submitted in my wife's name and she will be present at the hearing. I decided to represent her because she is a very nervous person and didn't want to challenge these scammers. I'm reading all the expert advice in this forum to write the WS. Do I mention in the WS that I am representer her as a Lay person with no legal knowledge0
-
No, because your wife writes the WS. You just rock up at court (or more probably on the phone) and announce that you are a lay rep. It has been advised that if it is to be a phone/video type hearing advise the court at that time. Have a copy of the lay representatives (right of audience) order to refer to - some judges don't get it.2
-
Bear in mind that you cannot be a witness and also a lay rep , so you are the latter which rules out the former
The court order will be addressed to your wife , telling her to submit her witness statement plus exhibits , not yours or you
You really need to get a grip on the arms length assistance you are providing to her
You are just an advisor , like Cummings was to BJ , nothing more ( DC was not the PM )2

I am not a witness all I'm doing is helping my wife write her WS and then represent her in court as she doesn't like these situations. I have no legal training or knowledge and that's why I'm reading all the posts in this forum and asking questions because I want to challenge these scammers and hopefully show other people who might not want to pursue this route that it is possible. I really do appreciate all the help and advice I've received so far.0
