OK, good - that means it's still in the system. But where are you phoning...? It's not DVLA... It's one of the courts.0 -

the thing is the speeding offense was 16 months
And ive found my licence and have checked online and i have zero pointsLooks like you may be in luck then. If you have no points on your licence there's more than a reasonable chance that court proceedings have not begun. To have done so they must have started ten months ago (they have six months to bring proceedings). If they started that long ago you would almost certainly have been convicted in your absence by now and would have points on your licence. If they proceedings haven't begun now they are time barred. The only scenario where you can still see court action is if the proceedings begun in time but have not yet been concluded. This is fairly unlikely. If you've got your one hundred smackeroonies back I wouldn't bother contacting anybody because no action can be taken against you.

But by not sending my licence would they be able to put points on the system ??
No. They have retuned your cash because they cannot impose points under the fixed penalty system unless they see your licence. Their only alternative is to bring court action and if they have not begun that process by now they are barred from doing so.
