Why are you complaining to Currys? They were not open so why did you park there? You never know how far you can go until you go too far.0

it makes me inclined to return the NTK without disclosing who was driving and see what they choose to do next. They will just carry on hounding you. It could continue for the next 5 years. This is the game you've just been joined into.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So do you suggest I just ignore the letter?Umkomaas said:it makes me inclined to return the NTK without disclosing who was driving and see what they choose to do next. They will just carry on hounding you. It could continue for the next 5 years. This is the game you've just been joined into.0 -
Why did the driver park there? Most retail car parks aren't free to then walk elsewhere.
NB we are not telling you to pay.
What's not clear about the advice about IPC firms, in the NEWBIES thread?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The car park used to be free to use, no parking company, no ticket machine.Coupon-mad said:Why did the driver park there? Most retail car parks aren't free to then walk elsewhere.

It is close proximity to the asda store without actually driving further around to the asda carpark which is usually busy.
Not sure when they put up signs and had a company police it.

Your options are: -
Complain to the landowner, but they may not be interested because the driver had no business being there.
Ignore everything for the next five years unless you get real court papers from a Scottish court.
Tell the PPC the keeper cannot be held liable because they live in Scotland where keeper liability does not apply, and therefore they should take this matter up with the driver who will not be named. Then ignore everything for the next five years except real court papers from a Scottish court.
My personal preference would be the third option.

Thanks for the options. I agree with you with regards the third option.
I have drafted this for the reply, if you dont mind reading it over and letting me know if I need to drop a line or add a line please?
I have highlighted the lines I have added.Does that cover any salient points?I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. If the car park was restricted or prohibited as stated on the notice to keeper, why was the car park not closed with a barrier to prevent parking on site?As the keeper of the vehicle, I cannot be held liable and as keeper liability does not apply so you should take this matter up with the driver who will not be named. It seems that this vague attempt to collect money under the current circumstances is opportunistic and in very poor taste.Meantime, I am taking up this matter with Currys/PC World and the local MP as I think companies like yours should be stopped for preying on people under all conditions.

So as stated earlier in the thread you can just ignore them (Scotland). And wait for the unlikely court papers.Ralph
