While it is not strictly in the rules, if all other parameters were met, then it is possible that Jestermum's husband could write himself a letter from his Ltd Co dated 9th June and return that to himself with the signed agreement also on 9th June and hence furloughed from 9th June which is before the last date for furlough.  This would need to be before the June pay-run RTI.

Sadly the OP is not clarifying whether her husband is working or shielding.  If he is working, he cannot claim CJRS from any date.  The business will have records of the dates he was working, so that is not worth bending the facts for.

The OP is also not clarifying the husband's status, so we cannot even comment as to whether other support such as BBLS would be available.
@Grumpy_chap Any post that relies on "not strictly in the rules", or "who is going to know anyway" is a post that's best deleted before actually posting it.

I find this area hard to understand. The CJRS allows claims to be backdated to 1 March, but the scheme did not exist on 1 March, so it is hard to see how they could have been furloughed from 1 March within the CJRS definition. It seems it must suffice to behave as if you were on furlough, that as an employee you had agreed with your employer to do no work from 1 March.
The furlough concept isn't a new one, only CJRS is. If they had temporarily laid off staff in a manner that complied with employment law/the scheme, then they would be eligible to backdate their furlough claim. There are certain industries who have these types of clause (temp lay off) as standard but they have (in recent years anyway) become less common with employers favouring zero hour contracts as they provide more flexibility for the employer.

If by "not strictly in the rules" you mean "commit fraud", then sure. Particularly falsifying documents/records - since the requirements for directors is to have it recorded officially in the company records/minutes. That would be an aggrevating factor to the offence/help prove intent.

@Jeremy535897 @unholyangel Yes, a moment of foolishness on my part.  Obviously the OP did not agree to be furloughed and is now too late to be furloughed.

If the OP clarifies that they are not sole trader self-employed and also whether they were working or shielding may impact whether SSP is available to them.  Also, the possibility of BBLS.  Otherwise, it looks like UC will be the only option.

Has the OP answered whether her husband has already been furloughed?

If yes, furlough again.  It's only too late now if he's never been furloughed previously.
