Whilst COPD could be a disability for employment law purposes it is not, as I understand it, automatically one.
Was the employer made aware that the OP considers themselves to be disabled? What medical advice do they have to back that up?
Or, was their condition so severe that a non medically qualified person should reasonably be aware of it?1 -
COPD = Chronic Obstructive Pulmonary DiseaseJReacher1 said:
I read the post as saying if you had COVID you would be classed as being disabled and thus being fired for having COVID was a case of disability discrimination.General_Grant said:JReacher1 said:
Really? I can’t see this being true at all.bucksbloke said:If COPD is a permanent condition - then you could have a case for disability discrimination. I would speak with ACAS
What don't you see as being true? That the COPD is a permanent condition or that there could be a case of disability discrimination?
COVID = CoronaVirus Disease

Opps misread that part.General_Grant said:
The OP said, "I received a letter of the NHS stating I had to self isolate until 30th June ". Their COPD status would be a reason for the advice.sharpe106 said:I am guessing the OP meant they were shielding rather then actually having it. Depending on why they were shiedling may have a case for disability discrimination.
(Note: COPD is not Covid)
me too, I thought it was a typo1 -

So which one of you was working for farmfoods? you appear to be suggesting it is ‘him’ but on this thread you say he is employed through his own Ltd company.

It would really help to be clear who is the person affected in this thread and whether it is the same person in the other thread, although they seem to have had a much longer employment time.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Did he receive a letter recommending that he self isolate or the one that recommends shielding - your post states that he is isolating? They are totally different. Having COPD managed simply with inhalers does not, on its own, usually lead to a recommendation to shield.0
