Solicitor cannot obtain old Planning Permission - what to do?

    Most Councils will have planning records from 1995 available online. If not you might be able to request it.

    If there was a planning condition, e.g no business use at a residential property, then it would normally have been written into the deeds as a covenant.

    I would stop worrying.

    Most Councils will have planning records from 1995 available online. If not you might be able to request it. 
    I think the development with leasehold flats and then this house were built after 1990 but probably completed before 1995, I don't have an accurate completion date - but that's more or less what I know for sure, so looks like the only way to get is physically by going to the council, I've asked my solicitor to find out more - if it's just a matter of going in there I will ask the seller to do so as I'm currently overseas and the onus is on the seller to provide it.

    When we sold our house last year we asked the council for the planning permission from 1970, it wasn't online at the time but was scanned and on the website within 3 hours. The buyers solicitors were trying the old indemnity policy scam, 2 issues that related to the 1970 extension.

    Sorry, I'm not sure I understand your question, can you elaborate please?
    Was the house built on its own or as part of a larger development? If the latter then you're unlikely to find a planning permission indexed under "21 Acacia Avenue" (or whatever), it will usually be one consent for the whole of "Oaktree Meadows Estate".

    Yes, it is part of a larger development - I cannot find it online, I looked it for based on postcode, do you have another suggestion? I hope my solicitor will provide more info on this tomorrow - regardless of that it sounds like most of you won't be worried about it, is that correct?

    There is no onus on the seller to provide this.
