You cannot threaten a counterclaim.
Why not?You never know how far you can go until you go too far.0 -
Because
- theyve already got a claim and so have a deadline
- they wont have time to communicate with a PPC, giving them the min 14 days notice to deal with a LBC
They have a choice of counterclaiming or not.2 -
That does not mean that you cannot still threaten them with one.

It is, however, almost certainly a waste of time and effort that is better put to actually, you know, filing a counterclaim.
I tend to cut through the useless, pointless actions and go straight for what might actually have an effect.2 -

You might. Does the OP? When theyre up against a deadline?
OP - do or do not. Dont threaten. We have seen 1 instance to my knowledge where a threat of a claim or counterclaim has produced any results.3 -
Google tells you the fees for court claims in the small claims track! A typical £900 counter claim, such as a couple of cass currently in progress through the courts against a well-known parking firm (cases that I am aware of) costs just £60 and you simply add the counterclaim words under the defence words...RoyalBlue82 said:I will do exactly that today (threaten counter claim) and AOS.
