What rights does it give over common areas? Any? If not ,you ARE in breach of lease, potentially.
Also, does your lease state what you are permitted to do? If you dont do what is permitted, again, breach.
Take this seriously, because the PPC might decide to drop you in it.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

i dont see the lease being an issue as there is noting in it stating i can not use communal parking areas and they have clearly allowed for parking bays. the fact i won the first case would lead me to believe the PCM  company have issued a ticket wrongfully which is my main concern

A lease states what you can do. It si there to grant rights
I fyou have no rights to park there, then youre in breach of your lease by doing so.
I get what yorue saying. Youve been told how to deal with teh PPC. But be aware that if I were the PPC I would try to make yuor life hell. After all, thats their normal modus. ANd so getting you for breach of lease - and of course, trespass - would be one thing to do.

Its unusual for a lease to not mention rights over communal areas
Bearing in mind that includes footpaths etc...

so just to be clear the bay is not marked for guess the 6 bays anyone can use as they are pay by phone with regards any restriction to parking you cant park on yellow lines and you cant park in other peoples marked bays other than that nothing else is mentioned no im not in breach of my lease
Do you mean guests or visitors?  It took me a while to work out why you were guessing about the 6 bays.

My main concern would be the fact you have PCM there, at all.  Your life will be a misery.  When my adult kids were looking for flats last year we refused to look at any place with a thug ex-clamper firm.  Read these:

    https://forums.moneysavingexpert.com/discussion/5997200/pcm-company-introduced

    http://parking-prankster.blogspot.com/2015/05/is-it-pcm-uk-who-make-up-stuff-all-time.html

Why the heck are this bunch near any residents and their cars...they are not needed, are not carrying out any service whatsoever.  They should be removed.  The leasehold owners of the flats should have refused to allow this, as per the first link.  As a tenant, you will be a victim of this scam all the time. Make sure you complain to the Managing Agents (NOT YOUR LETTING AGENT) every time, and give them the Parking Prankster link and say how shocked you are that these ex-clampers who were outed on Watchdog for ''making it up'' re appeals, are marauding around fining residents like sutting ducks and ruining people's implied right to peaceful enjoyment at this property.  Get angry about this.

This conduct is a 'private nuisance' caused by the Managing Agent signing a contract with an unsuitable firm.  Trouble is, there are no suitable parking firms.  They have NO PLACE at your home.

    **UPDATE**
so my second appeal to PCM has been rejected. So they read my appeal which is in my OP and said they don’t accept I didn’t see the sign which was not my point. My point was that I did not park in the restricted bays they said I can apply to the ias should I???
