VILLA PLUS DEMANDING PAYMENT OF BALANCE ON PACKAGE HOLIDAY BOOKED WHEN JET 2 ARE NOT FLYING IN JUNE

BOOKED A PACKAGE HOLIDAY WITH VILLA PLUS BACK END OF JANUARY/EARLY FEBRUARY. SEVERAL REMINDERS TO PAY THE BALANCE IN APRIL AND NOW AFTER SEVERAL DEFERRAL DATES FOR BALANCE PAYMENT WE NOW HAVE A FINAL BALANCE DUE DATE OF 1 JUNE 2020. HOLIDAY IS TO MAJORCA ON 27 TH JUNE WITH JET 2. JET 2 ARE NOT FLYING IN JUNE SO WE ARE UNWILLING TO PAY FOR A SERVICE THAT VILLA PLUS CANNOT PROVIDE. THEY WIILL NOT REPLY TO LETTERS (THREE TO HEAD OFFICE), NOR TEXTS AND THEY DO NOT ANSWER THEIR PHONES (CUT OFF AFTER 20 MINS) . THEY ARE GENERATING BOG STANDARD TEXT REPLIES WHICH BASICALLY READ NO PAYMENT FROM CUSTOMER AND WE WILL CANCEL THE HOLIDAY THE DAY AFTER WITH LOSS OF DEPOSIT INCLUDING OUR FLIGHT COSTS TOTALLING OVER £1350. WHAT IS JUST SO ANNOYING IS YOU CAN'T GET TO SPEAK TO ANYONE AND THEY WILL NOT BUDGE ON HELPING THE CUSTOMER.

Perhaps take the caps lock button off, break into readable paragraphs and ask your question if any?
If just a rant fair enough, there is a separate board for that.

I think your keyboard may be broken.
I don't envy your situation as it is difficult. It would appear they are saying that if you don't pay the balance, they will treat it as a customer cancellation under their T&Cs so you would lose the deposit etc. You could then try and claim the money back as you had proof the holiday wasn't going to happen, you couldn't get in contact etc, but you may have a long and hard fight on your hands - you'd effectively have to argue unfair contract terms against them and may even have to pursue them to court.
If they cancel the holiday you are entitled to a full refund. Whether they will try and give vouchers or not I don't know, but the law is on your side and you would be entitled to a full refund. It is my view that's the easiest option, as ridiculous as it might seem to pay a large balance for something that's not going to happen - but you will have kept your side of the contract so the law would be with you. It might take some time to get that refund though.
There's a very outside chance that they could source alternative flights for you and the holiday still goes ahead.
